RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-145-87 be received; and
2. THAT the rezoning application and the Hamlet Plan Amendment application, filed by
Mr. Gordon, to permit the creation of one (1) additional residential lot, be denied
without prejudice due to insufficient area for a private sewage disposal system.
BACKGROUND ANU CUNIMENT:
On Nlarch 20, 1987 the Planning Department received the application for rezoning. The
application for the Hamlet Plan Amendment was submitted on March 16, 1987. The applicant
was requesting changes to permit the creation of one (1) additional residential lot.
The subject lands are designated as part of the Hamlet of Haydon by the Durham Regional
Official Plan. The plan does permit infilling and minor additions to the Hamlet. This
can be considered as an infilling situation.

The subject site is presently zoned as "Residential Hamlet Exception (RH-1)"
by the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended.
This special zone was put into place in 1982 when the applicant created the
subject parcel. At that time there was concern regarding the impact upon
the creek which 1 i es to tt~e east of the property. The 1 of was designed so
as to not impact upon the creek. The minimum lot area was set as
S,000m2 due to topographic constraints.
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
appropriate signage acknowledging the application was installed on the
subject lands. Staff would note that no objections to the proposal were
received at the writing of this Report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted within St aff
Report PD-99-87. Staff would note the following departments/agencies, in
providing comments, offered no objections to the application as filed:
- Newcastle Fire Department
- Newcastle Building Department
- Central Lake Ontario Conservation Authority
Regional Planning Department
"Further to your letter of March 23, 1987, received in this Department March
3U, 1987, we have reviewed this matter and wish to provide the following
cornme nt s .
1. The subject lands are within the Hamlet of Hay don identified in the
Durham Regional Official Plan as a hamlet limited to infilling and
minor additions.
2. We note that the Durham Regional Department of Nealth Services has, by
letter dated April 16, 1987 (copy attached), indicated that the
property is not suitable for private waste disposal systems. We would
not be prepared to recommend that an amendment to the Development Plan
to implement the requested severances be approved until this issue has
been resolved.

3. The Regional Works Department has advised that municipal water and
sewer facilities are not available to this area. The usual Regional
requirements will be dealt with by way of appropriate conditions of the
subsequent land division severance should the private servicing issue
be resolved."
Regional Health Services Department
"The above application for rezoning has been re-investigated by this Health
Department, and is not approved.
The property is not suitable for on-site sewage disposal for two (2) lots
due to the steep slopes on the property and the availability of suit able
land area for private sewage disposal.
The applicant submitted a report by Site Investigation Services Limited in
support of the creation of a new lot. The Health Department has reviewed
this material and has commented that the site is not capable of containing a
septic system. The proposed lot would be less than 1,000m2 in area
whereas the current zone requires S,000m2 per lot. The requirement for
large lot areas is based on the rough topography. A great deal of the lot
is sloping and it is difficult to locate a sewage disposal system. Also, on
a lot of less than 1,000m2, there is no room for a replacement ti le
field. This is another factor which the Health Unit takes into account.
Staff are unable to support the application for an additional lot in this
location. The applicant is requesting a lot which is greatly undersized.
The proposal suggests an area which is one third the size acceptable in an
"RH" zone. This site is subject to development constraints and would
require an even larger than normal area. The subject site was created as an
exception to the by-law and, further division of the parcel cannot be

supported due to topographic constraints and the concerns of the Health
Department. Accordingly, Staff recommends that both applications be
denied.
