0.3 METRE RESERVE
PART LOT 6, CONCESSION 2, FORMER TOWN OF BOWMANVILLE

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PU-148-87 be received; and
`L. THAT hir. & Mrs. Eikens be notified that the Town of Newcastle does not support the
lifting of the 0.3 Metre Reserve fronting Concession Street.
BACKGROUND AND COMMENT:
Staff would note for the Committee's information that Council, at their meeting held on
Monday, March 10, 1986, approved the following recommendation in respect of the above-
noted lands:
"THAT the application for rezoning of Part of Lot 9, Concession 2, former Town of
Bowrrianville, submitted by N1r. & Mrs. Eikens to permit the severance of a 3000
square metre lot supporting a single family dwelling, be approved and that the
attached by-law (No. 86-33) be approved."
In consideration of the Transportation policies within the Durham Regional and Bowmanville
Urban Area Official Plan and the designations of both Concession Street and Mearns Avenue,
as a Type 'B' Arterial Road, Staff had requested that consideration be given to the

dedication of a 0.3 Netre Reserve along the frontages of Concession Street
and Mearns Avenue, however, excluding the proposed severed lot on Mearns
Avenue.
The Town of Newcastle Works Department, in commenting on the original
application, noted that within the Bowmanville Urban Area Official Plan, the
intersection of Concession Street and Mearns Avenue was so noted on Schedule
"3" - Transportation Network as intersection improvements required.
Accordingly, Works Department advised that they would have no major
objections to the application as submitted, however, noted that appropriate
road widenings with respect to the intersection improvements would be
required to be deeded to the Town of Newcastle, free and clear of all
encumbrances.
Nir. Peter Feddema, on behalf of Mr. & Mrs. Eikens, indicated through
correspondence with the Works Department, that Mr. Eikens was agreeable to
the dedication of the 0.3 Metre Reserve fronting Concession Street and
Mearns Avenue, however, would be willing to negotiate as to the parcel of
land required for the re-alignments of the Mearns Avenue/Concession Road
intersection. Although the U.3 Metre Reserve has been provided, Staff would
note, that to date, the provision of appropriate road widenings has not been
finalized.
The Region of Durham Works Department, in responding to the request for the
removal of the 0.3 Metre Reserve, noted the following:
"Should the Town's General Purpose and Administration Committee adopt a
motion to remove the reserve, we would request that it be contingent upon
the following:
1) That the owners enter into a servicing agreement with the Region for
payment of Regional Development Levies and to ensure that any
buildings erected thereon would pay all applicable sanitary sewer main
frontage charge and connection charges at the rate in effect at such
time as a sanitary sewer main became available. Furthermore, the
building or buildings constructed thereon would have to connect to the
Regional sanitary sewer main within 6 months of the sewer becoming
available.

2) That the owners pay the outstanding watermain frontage charge for
the watermain not previously assessed.
3) That the owners pay for the installation of a water service connection
within the road allowance in order to provide water service to the
property line of the vacant lot for the proposed residence.
4) That the owners satisfy the Regional Legal Department in regard to
their fee for the preparation and registration of the Agreement noted
under Item No. 1 above."
It is Staff's opinion, as previously expressed within Staff Report PD-57-86,
that until such time as the subject lands are contemplated for development
in conjunction with adjacent lands within Neighbourhood 1D, in compliance
with the provisions in the Durham Regional and Bowmanville Urban Area
Official Plans, and the transfer of the appropriate road widenings has been
completed, the lifting of the 0.3 Metre Reserve would be premature. If,
however, Council is in favour of this request, it is recommended that
approval be conditional upon satisfying the Town's requirements for road
widenings to facilitate future intersection improvements as well as the
Region's conditions for approval; all to be at the applicant's expense.
