THAT Report PD-127-87 be received; and 2. THAT Amendment No. 3 to the Enniskillen Hamlet Development Plan attached hereto be approved in principle; and 3. THAT Amendment No. 3 to the Enniskillen Hamlet Development Plan be forwarded to Council for final approval at such time as the Council of the Region of Durham has considered the subject amendment; and 4. THAT the proposed Amendment be forwarded to the Region of Durham for their information and consideration at such time as Staff have received the required Engineering Report and are satisfied with the recommendations and findings of said report. BACKGRUUNU AND COMMENT: On Nlarch lU, 1987 the Planning Department received an application filed by Mr. Graham Dallas on behalf of Kalee Investments. This application was filed to amend the Enniskillen Hamlet Development Plan to permit the development of four (4) residential lots. ...2 J REPURT NU.: PD-127-87 Page 2 The subject lands are designated as "Hamlet" by the Durham Regional Official Plan. The proposed use of the lands as Low Density Residential lots conforms to the intent of the plan. The subject lands were severed into four (4) parcels earlier this year. The need for an Engineering Study and the amendment to the Hamlet Plan are two requirements of the Town for the approval of the severances. The subject lands are already zoned appropriately to permit this development. The zoning is "Residential Hamlet Exception (RH-3)". The proposed lots all conform to the minimum lot area and frontage requirements of the appropriate section. Staff would note for the Committee's information that pursuant to Council's resolution of July 26, 1982, the appropri ate si gnage acknowledging the application was installed on the subject lands. Staff would note that no objections to the proposal were received at the writing of this Report with respect to the amendment requested. In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies as noted wi thi n Staff Report PD-98-87 . Staff would note the following departments/agencies, in providing comments, offered no objections to the application as filed: - Newcastle Fire Department ' - Newcastle Building Department - Regional Planning Department - Regional Health Department - Ministry of Agriculture and Food - Ministry of the Environment The Regional Works Department had no objection to the principle of the application and had provided this comment to the Land Division Committee. There was a requirement that the site make use of a shared driveway ...3 ~J REPORT NO.: PD-127-87 Page 3 accessing the road from the retained lands. This was incorporated in the Land Division Committee's decision. This was a requirement due to the difference in elevation from the property limit to the built up part of the road. The remaining requirements will be fulfilled through the Land Division approval process. The Regional Health Department also investigated the application for the Land Division Committee, as well as for this application. The comment provided no objection to the approval of the Hamlet Plan Amendment. At the time of the writing of this Report, Staff had not received comments from the Central Lake Ontario Conservation Authority. Verbal ~'' comments were solicited by Staff and the Authority had no objection, in principle, to the amendment. The Authority has required that all fill to be used on the site be approved. This is a standard requirement and prior to the issuance of a building permit, written approval from the Authority is required. The Regional Planning Department has provided a "No Comment" on this application, but did note that Regional Council is required to review this amendment prior to the adoption by Town Council. This has been incorporated into the Staff comments. There is a requirement in the Town's Official Plan for the applicant to provide an Engineering Study based upon test drilling which confirms: - soil conditions satisfactory for the effective operation of a private waste disposal system; and - no adverse effects upon existing water supplies and an adequate supply of potable water to service the proposed development; and - an adequate separation between water table and septic the fields. Staff do not anticipate any major problems to be identified by such Study since the applicant has already provided a similar Study for the subdivision to the north of this site. Once the study has been finalized and submitted for Staff's review, and assuming that the report confirms a potable water supply and proper soil conditions, the amendment shall be forwarded to Regional Council for review. ...4 C REPQRT NO.: PD-127-87 Page 4 After review of the proposal, Staff have not identified any reason for concern. Only the requirement for the Engineering Report remains to be fulfilled. Once this information is provided, Staff will be in a position to complete the processing of this application. April 21, 1987 CC: Kalee Investments Ltd. c/o Mr. Graham Dallas R.R. #1 BUWMANVILLE, Ontario L1C 3K2 ~J AMENDMENT N0. 3 TO THE HAMLET DEVELOPMENT PLAN FOR THE HAMLET OF ENNISKILLEN PURPOSE OF AMENDMENT The purpose of Amendment No. 3 to the Hamlet Development Plan for the Hamlet of Enniskillen is to increase the maximum number of permitted lots within the area designated "Rural Residential" in Part Lot 19, Concession 8, former Township of Darlington from "2" to "4". BASIS OF AMENDMENT This amendment to the Hamlet Development Plan for the Hamlet of Enniskillen is based upon an application submitted to the Town of Newcastle to amend the Plan to permit the development of four (4) residential lots on the subject lands. ACTUAL AMENDMENT 1. Schedule "1" to the Hamlet Development Plan for the Hamlet of Enniskillen is hereby amended by changing from "2" to "4" the maximum number of residential lots permitted in the "Rural Residential" area in Part of Lot 19, Concession 8, former Township of Darlington, as shown on the attached Schedule "X" hereto. 2. Schedule "X" hereto shall form part of this Amendment. IMPLEMENTATION The provisions set forth in the Town of Newcastle Official Plan regarding the implementation of the Plan shall apply in regard to this Amendment.
