RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-131-87 be received; and
2. THAT the application for rezoning submitted by Mr. F. Reid of Reid and Brown,
Barristers & Solicitors, on behalf of Mr. & Mrs. Vanderbelt for rezoning of Part of
Lot 8, Concession 1, former Town of Bowmanville to permit the severance of a parcel
of land with two (2) existing dwellings be approved.
BACKGROUND AND CUhiMENT:
Un March 3, 1987, the Planning Department received an application for rezoning filed by
hir. F. Reid on behalf of Mr. & Mrs. Vanderbelt. The application was to amend the Zoning
By-law to recognize a situation which has two (2) residences on one lot and thereby permit
a severance to create two (2) residential lots.
The subject lands are designated as "Major Open Space" with an indication of hazard lands,
and environmentally sensitive area. The Regional Planning Department has provided a
written comment which states: "The proposal to recognize two existing residential
dwellings may be permitted". The subject lands are outside of the Bowmanville Major Urban

Area, therefore the requirements of the Durham Regional Official Plan must
be adhered to.
The subject lands are currently found to be in two zones; "Agricultural (A)"
and "Environmental Protection (EP)". The proposal is to recognize the two
(2) existing homes and a special exception zone will be required to permit
the severance.
Staff would note for the Committee's information that pursuant to Council's
resolution of July 26, 1982 and the requirements of the Planning Act, the
~"'` appropriate signage acknowledging the application was installed on the
subject lands. Staff would note that no objections to the proposal were
received at the writing of this Report with respect to the amendment
requested.
In accordance with departmental procedures, the application was circulated
to obtain comments from other departments and agencies as noted within Staff
Report PD-93-87. Staff would note the following departments/agencies, in
providing comments, offered no objections to the application as filed:
- Newcastle Works Department

- Newcastle Building Department
- Newcastle Hydro-Electric Commission
- Ministry of Agriculture and Food
- Ministry of Transportation and Communications
The Central Lake Ontario Conservation Authority has provided the following
comment to Staff:
"The subject site is partially situated within the Regional Storm
floodplain of the Soper Creek. However, the flood-susceptible portion of
the site is retricted to a relatively small area, along the northern and
western property limits and none of the existing structures are flood-prone.
Providing the floodplain portion of the site remains within an
"Environmental Protection" zone, to reflect the potential flood risk
associated with this portion of the lot, Staff would have no objection to
the application of a residential rezoning to the balance of the property."

In respect of these comments, Staff have confirmed that the area to be
rezoned does not include the area currently found within the "Environmental
Protection (EP)" zone.
the Regional Health Department has provided the following written comments:
"Please be advised that this Department has no objection to the above
rezoning. However, the number of lots that are suitable for on-site sewage
disposal will be determined when the severance is circulated to this
Department along with other pertinent information."
Staff would note that both of the existing dwellings and the associated
septic systems and wells are all existing. The confirmation of the number
of lots appear to be only a technical requirement.
After reviewing the application and all of the comments which have been
supplied, Staff has no objection to the approval of the rezoning
application. Accordingly, Staff has no objection to the approval of the
rezoning application. Accordingly, Staff has prepared a by-law to recognize
* the existing uses and the existing lot areas and recommend that the attached
by-law be forwarded to Council for approval.

BY-LAW NUMBER 87-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Town of Newcastle enacts as follows:
1. Section 6.4 "SPECIAL EXCEPTIONS - AGRICULTURAL (A) ZONE" of
By-law 84-63 is hereby further amended by adding thereto the following new
Subsection 6.4.27 as follows:
4~ "6.4.27 AGRICULTURAL EXCEPTION (A-27) ZONE
Notwithstanding Section 6.1, those lands zoned "A-27" on the
Schedules to this By-law shall only be used for an existing single
family dwelling and uses accessory thereto. The placement of all
buildings shall be in accordance with the provisions of Section 9.2
with the following exceptions:
a) Lot Area (minimum) 1200 square metres
b) Lot Frontage (minimum) 30 metres"
2. Schedule "3" to By-law 84-63, as amended, is hereby further amended
by changing the zone designation from "Agricultural (A)" to "Agricultural
Exception (A-27)", as shown on the attached Schedule "X" hereto.
3. That Schedule "X" attached hereto shall form part of this by-law.
4. This By-law shall come into effect on the date of passing hereof,
subject to the provisions of Section 34 of the Planning Act.
