wAEREAS the Municipal Council of the Corporation of the Township
of Darlington deems it expedient to construct an overhead bridge to carry
Courtice Road over and acxosa the right-of-way of the Canadian Pacific
Railu-ay Company, and has applied to the Bosrd of Transport Cormnissioners
for Canada. for an order to construct the aforesaid work,
AND Wf~REAS the Board of Transport Coianissioners for Canada ]a,e, by
order No. 101103, as ataended by order No. 101582, has ordered that the
Township of Darlington is authorized to undertake the construction as
aforesaid, in accordance with the requirements oP General Order No. 848,
and that the costa shall be borne as follows; Eighty per cent of the
cost of construction of the said overhead bridge, or the sun of X120,720,00,
whichever is the lesser, shall be paid out of the Railway Grade Crossing
Fund, five percent by the Canadian Pacific Railway Company, and the
balance oP the cost, as well sa the cost of future maintenance shall be
borne and paid by the applicant,
AND WHEREAS the Townships share of the aforesaid cost is included
in estimates of the current year approved for subsidy by the Ontario
Department of Highways, as part of By-law 2156.
NOW TFIEREi'ORE pursuant to the Municipal Act R,S,O, 1950 Sections
469, 1, a, 428, and 436, the bunicipal Council of the Corporation of the
Township of Darlington hereby enacts:
1. The construction is hereby authorized of an overhead bridge to
carry Courtice Road across and over the right-of-way of the Canadian
Pacific Railway Company, together with the construction of the necessary
approaches and the acquisition of the necessary lands for the said
bridge and approaches thereto, as shown on the plans now on file with the
Board of Transport Ceaauissioners for Canada under file No, 26727.68,
