Minutes of the Committee of Adjustment

Preliminary Note
In response to the Province's Emergency Order and to maintain physical distancing
during the COVID-19 pandemic, this Committee of Adjustment meeting took place in an
electronic format. Members listed as being "electronically present," as well as applicants
and members of the public, participated though the teleconferencing platform Microsoft
Teams, which allows participation through a computer's video and audio, or by
telephone.

Chairperson, Todd Taylor called the meeting to order at 7:00 pm.

There were no pecuniary interests stated for this meeting.

3.1 A2020-0015 Owner/applicant: Cosmas Gikizas

Cosmas Gikizas, the applicant and owner of the property, participated by telephone. He
gave a verbal presentation to the Committee in favour of the application. The applicant's
presentation provided similar arguments and details as provided in the recommendation
report prepared for this application.

No Committee Members had questions or comments.
No other persons spoke in support or opposition of the application.
Motion to approve as recommended moved by Dave Eastman, seconded by Shelly
Pohjola.
Full text of decision:
"That application A2020-0015 for minor variance to Section 12.2 d. iii) b of Zoning By-
law 84-63 to recognize existing side yard setbacks to permit the interior renovation of
the garage into living space be approved as it is minor in nature, desirable for the
appropriate development or use of the land and maintains the general intent and
purpose of the Zoning By-law, the Durham Region Official Plan and Clarington Official
Plan."

3.2 A2020-0012 Owner: 2681998 Ontario Inc.
Applicant: API Development Consultants
1 Spicer Square, Bowmanville
Dave Barnard, a representative of API Development Consultants, participated by
telephone. He gave a verbal presentation to the Committee in favour of the application.
The applicant's presentation provided similar arguments and details as provided in the
recommendation report prepared for this application.
Committee Member Dave Eastman asked if the parking study commissioned by the
applicant included employee parking. The applicant explained that it did, and that the
proposed development would provide one more space than the parking study
determined would be necessary.
Committee Member Shelly Pohjola asked the applicant to speak to the rationale for the
reduction of loading space. The applicant explained that the largest vehicle that would
be on site would be a garbage truck, and that all supplies would come via cube vans as
the hotel does not require much loading due to it not being a full-service hotel and
providing only the breakfast meals to customers.
No other Committee Members had questions or comments.

Motion to approve as recommended moved by Noel Gamble, seconded by John Bate
Full text of decision:
"That application A2020-0012 for a minor variance to:
i. Section 19.3 d. of Zoning By-law 84-63 to reduce the minimum front yard
setback from 15 metres to 2.4 metres;

Section 19.3 f. of Zoning By-law 84-63 to reduce the minimum exterior side
yard setback from 10 metres to 5 metres;
iii. Section 19.3 j. ii) of Zoning By-law 84-63 to reduce the minimum distance
between an intersection and the point of site ingress/egress from 50 metres to
43 metres;
iv. Section 3.12 c., e. and f. of Zoning By-law 84-63 to reduce loading space
requirement from two, 4 metre by 11 metre spaces to one, 3 metre by 7.5
metre space, which may be located partially within the exterior side yard
setback and not abutting the building;
V. Section 3.16 e. of Zoning By-law 84-63 to reduce the number of parking
spaces from 84 spaces to 78 spaces; and
vi. Section 19.3 d. and f. of Zoning By-law 84-63 to allow a setback of 0.6 metres
from the corner of the building to the property line along the visibility triangle,
be approved as it is minor in nature, desirable for the appropriate development or use
of the land and maintains the general intent and purpose of the Zoning By-law, the
Durham Region Official Plan and Clarington Official Plan."

4. Adoption of Minutes of Previous Meeting
Motion to approve moved by Dave Eastman, seconded by Noel Gamble.
"That the minutes of the Committee of Adjustment, held on February 20, 2020 be
Approved."
