6, (d) The maximum number of residents which the applicant proposes to
acemnodate at one time,
(e) The number of bath tubs or showers, wash-basins and flush toilets
available for use by the residents,
(f) such other infor!nation as the Board may require.
7, Each application for a license or renewal of a license shall be accanpanied by
(a) a certificate of an officer authorized to inspect buildings under
the Fire Marshals Act certif~+ing that the premises have been inspected
by him within 3 months of the date of application and that they
are reasonably safe from fire hazard; and
(b) a certificate of the Medical Officer oP Health certifying that the
premises have been inspected by him or his representative within
three months of the date of the application, and that, in his opinion,
they are in reasonable compliance with the requirements of this
By-law,
8, The occupier shall provide sleeping accomodation,for residents in romans with a
minimum of
(a) 400 cubic feet of air space and fifty square feet of floor space
for each persor. under sixteen years of age,
(b) 600 cubic feet of air space and seventy-five square feet of floor
space for each person sixteeh years o° age and over,
and each room so used shall contain at least one vrindow opening directly to the
outside air, and the size o.° the window shall be not less than 10 per cent of
the floor area of the room and shall be capable of being opened or closed at
all times,
9. Sleeping accomodation shall not be provided in any space in the premises used
as a lobby, hallway, closet, bathroom, stairway or kitchen,
10. The ocempier shall provide toilet and bathing facilities which are readmly
accessible to all residents with a minimum of one wash-basin and one flush
toilet for every eight residents and one bath-tub or shower for every twelve
residents,
11. The occupier shall not admit or retain as a resident any maternity case, or
any person who requires treatment for alcoholism, drug addiction, mental illness
or disease, or any person who requires active medical or surgical care or
treatment of a kind usually provided in a hospital,
12, The occupier shall
(a) provide for nursing services for residents by or under the supervision
of a registered nurse, and
(b) ensure that medical care and attention are made available by a duly
qualified medical practitioner to residents as required,
13. The occupier shall employ such persons who are in the opinion of the Board or
the ~4edieal Officer of Health sufficient in number and qualified to provide
the nursing services and personal care required by the residents,

11~, The occupier shall provide
(a) nourishing meals at regular intervals and special diets, where required,
prepared by or under the supervision of a competent person, and
(b) adequate and sanitary supplies of milk and drinking water,
15. The occupier shall keep or cause to be kept, a register of persons resident in
the nursing have which shall set forth
(a) the name, age, sex and former place of abode of each resident,
(b) the date and circumstances of his admission to the hone,
(c) a record of all medical examinations after admission, the diagnoses and
orderes of duly qualified medical practitioners, and the medicines, medications '
and areatments prescribed or administered
(d) the date, the circumstances of his discharge from the home and the name and
address of the person or institution in whose care or to which he was
discharged,
(e) in the event of the death of the resident, a record of the circumstances
of the death and the name and address of the person claiming the body, and
(f) such other additional information as may be required by the L4edical Officer
of Health.
16, The occupier shall maintain the nursing home in a thoroughly clean,<aafe and
sanitary condition, and without limiting the generality of the foregoing, he shall
(a) eliminate fire hazards including the provisions and maintenance of
(i) protection from radiators or other heating equipment,
(ii) water supplies adequate for all normal needs including those of fire
protection, and
(iii) at least two separate means of egress to the outside from floors
with sleeping accomodations;
(b) maintain a minimum temperature of 6~ degrees Farenheit in the nursing home
from the 1st of October to the 31st of PSay;
(c) have the premises inspected at least once in every 12 months by an officer
authorized to inspect buildings under the Fire Ivlarshals Act;
(d) have the premises inspected at least once in every 6 months by the iviedical
Officer of Health or his representative;
(el deep all parts of the building free fro~tt rubbish, garbage, ashes, flammable
materials and other t3ebris;
(f) keep the cellar of the nursing., have well drained and ventilated;
(g) keep the nursing have weatherproof, Free from dampness, adequately heated,
and all heating equipment in good repair;
(h) maintain adequate kitchen equipment and facilities to ensure the proper
preparation and protection of food;
(i) take all necessary steps to keep the building free from vermin, insects
and pests,
17, The Medical Officer of Health or his representative, an officer authorized to
inspect buildings under the Fire Marshals Act or any employee of the
Corporation required to administer or enforce the provisions of this By-law may
enter a nursing home at any and all reasonable times for the purpose of inspecting
the premises and every part thereof to ascertain whether the provisions of this
By-lax- are being or have been complied with, and it shall be an o`fenae for any
person to prevent or obstruct any such official from carrying out his duties under
this By-law,

18. In every nursing home, the licence shall be posted in a conspicuous place in
the lower hallway and a printed copy of this By-law shall be made available by
rthe occupier for examination upon the request of any resident in the nursing
home.
19. The Board may at any time revoke any license issued under this By-law, and
notice thereof shall be given by the Board by registered letter mailed to the
occupier at the address in respect oY which the license was issued,
20, Each license shall be in force for one year from the ist day of December to the
31st day of November,
21. Any occupier or other persons concerned in the management of a nursing home
who is guilty of an offence under this By-law shall on sw:unary conviction be
liable to a penalty of not more than ~ 100,00 for each offence,
22, This By-law shall take effect on and from the 1st day of December 1958.
