THAT Report PD-135-93 be received; 2. THAT By-law 92-57, a By-law to adopt Amendment No. 48 to the Official Plan of the former Town of Newcastle be repealed; 3. THAT the attached By-law to repeal the above referenced Official Plan Amendment be passed and forwarded to the Ministry of Municipal Affairs and the Durham Regional Planning Department; 4. THAT application files OPA 90-104jN and DEV 90-098 be closed; and 5. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. In December of 1990, the Planning and Development Department received an application to amend the Official Plan of the former Town of Newcastle and to amend Comprehensive Zoning By- law 84-63 of the former Town of Newcastle in order to permit a 77 unit apartment building at the northwest corner of Liberty street and Baseline Road in Bowmanville. 2. On February 24, 1992, Council approved the proposal and passed By-law 92-57, being a By-law to adopt Amendment No. 48 to the Official Plan for the former Town of Newcastle. The Amendment was subsequently forwarded to the Ministry of Municipal ....2 554 RECYCLED PAPIER PAPER RECYCLE REPORT NO. PD-135-93 PAGE 2 Affairs for approval. To date, the amendment has not recei ved the final approval of the Ministry of Municipal Affairs. 3. In June of 1993, the Planning and Development Department was approached by the new owners of the subject property and was advised that they were not interested in developing the site for apartments as per Amendment # 48. The new owners intended to develop the property in accordance wi th the existing Official Plan designation and the existing service station Commercial (C7) zone category. 4. Amendment # 48 is currently awaiting approval from the Ministry of Municipal Affairs and if approved, would prohibit the new owners to use the site for service station and related uses. The new owners have been advised of the potential problem and have advised staff in writing that they wish to abandon Amendment No. 48. As a result, it is necessary for Council to repeal By-law 92-57 which adopted Amendment # 48. Respectfully submitted, o r~~ ~ Franklin Wu, M.C.I.P. WHEREAS By-law 92-57 was passed to adopt Amendment No. 48 to the Official Plan of the former Town of Newcastle. AND WHEREAS the new owners are no longer interested in proceeding with amendment No. 48 to the Official Plan of the former Town of Newcastle. AND WHEREAS the Council of the Municipality of Clarington deem it advisable to repeal By- law 92-57. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. By-law 92-57 is hereby repealed. 2. That this By-law shall come into effect on the date of the passing thereof. BY -LA W read a first time this day of 1993. BY-LAW read a second time this day of 1993.
