THAT Report PD-134-93 be received; 2. THAT Council concur with the decision of the Committee of Adjustment made on September 16, 1993; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Town for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. On September 16, 1992 , the Committee heard four (4) applications for minor variance, approving three and tabling the other application. Details of each application and decision of the Committee is attached for information. 1.2 Application A93/029 to A93/031 inclusive were filed by Geranium Homes (Courtice) Ltd. to permit the construction of linked dwelling units with reduced exterior side yards. The variances applied for varied from a setback of 2.9 m to 3.8 m as opposed to the 6.0 m minimum required. A number of existing residents were in attendance at the meeting. The residents supported the applications, as the units proposed were to be similar in size to their own, should the variances be granted;; 548 . . . .2 RECYCLED PAPIER PAPEr, RECYCLE REPORT NO.: PD-134-93 PAGE 2 One application was TABLED as it required further variance to the front yard setback. Staff did not support the applications as being minor in nature. However, in consideration that the proposed reductions do not reduce sight triangles or pose a safety problem, and for the most part is limited to the rear portion of the dwelling, as well as the cost and time of an appeal, Staff do not suggest appealing the decisions of the Committee. 1. 3 Staff have reviewed the Committee's decision and are satisf ied that' the decision conforms to the general intent of the Official Plan and the Zoning By-law. 1.4 Council's concurrence with the Committee of Adjustment decision is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment.
