PART LOTS 15/16, CONCESSION 2, FORMER TWP. OF DARLINGTON FILES: 18T-88046 (PHASE II) and DEV 88-030 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-128-93 be received; 2. THAT rezoning application submitted by West Bowmanville Developments Limited requesting the removal of the "Holding (H)" symbol from the subject lands within draft plan of subdivision 18T-88046 being Part of Lots 15 and 16, Concession 2, former Township of Darlington for Phase II be APPROVED and the By-law attached hereto be forwarded to Council for approval; 3. THAT any delegations and those persons listed in this report be advised of Council's decision; and 4. THAT a copy of this report and the amending by-law be forwarded to the Region of Durham Planning Department. 1. STAFF COMMENT: 1.1 Council at their September 14, 1992 meeting, in response to West Bowmanville Developments request, approved By-law 92-193 removing the "Holding (H)" symbol from a portion of the lands within draft plan of subdivision 18T-88046, that coincided with the limits of their proposed Phase II development. 1.2 It was anticipated at that time that registration would proceed in the fall of 1992. . . .2 40 PAPIER RECYCLE TIW; IS PfHfTED ON ReCYCLED PAPER REPORT NO.: PD- 128-93 PAGE 2 1.3 West Bowmanville Development Ltd. subsequently indicated to staff that circumstances and marketing trends dictated that minor revisions to the draft plan of subdivision were necessary prior to proceeding with Phase II development. 1.4 The minor revisions as requested were subsequently approved by Council and received the approval of the Region of Durham on July 8, 1993. 1.5 In light of the revisions to the conditions of draft approval, the limits of Phase II have been altered to include additional lots for semi-detached units as well as reducing the number of townhouse blocks. 1.6 According, it is prudent for the Municipality to repeal By-law 92-193 and pass in its place, another by-law removing the "Holding (H)" symbol for the lands within Phase II under the recently registered Plan 40M-1734. Director of Planning and Development LDT*FW*jip *Attach 8 September 1993 , 4"- t ,,-) t ON: HOLOING.BYL THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 93-_ being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the former Municipality of Clarington and to repeal By-law 92-193. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the former Municipality of Clarington in accordance with application OEV 88-030 to permit the development of Phase 2 of Plan of Subdivision 18T-88046. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. By-law 92-193 is hereby repealed. 2. Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone category from: "Holding - Urban Residential Type One ((H)R1)" to "Urban Residential Type One (R1)", "Holding - Urban Residential Type Two ((H)R2)" to "Urban Residential Type Two (R2)" and "Holding - Urban Residential Type Three (H)R3)" to "Urban Residential Type Three (R3)". 3. Schedule "A" attached hereto shall form part of this By-law. 4. THAT this By-law shall come into effect on the date of the passing thereof, subject to the provisions of Section 36 of the Planning Act. BY-LAW read a first time this day of 1993.
