AND THE HASIUK FAMILY Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-120-93 be received for information and that no further action be taken on matters related to the Hasiuk's property; and 2. THAT Mr. William J. Hasiuk, Mr. Gerald Hasiuk, Mr. William Hasiuk, Mrs. sylvia Polak, and the M.T.O. be advised of Council decision. REPORT: 1. As per Council's direction, the Director met with officials from the Ministry of Transportation and members of the Hasiuk family including, William Hasiuk, his sons, Bill, and Gerald, daughter sylvia and her husband Bill Polak on August 6, 1993 to discuss matters related to the Freeway connecting Link between Highway 401 and the proposed Highway 407 as pertaining to the Hasiuk farm located in Part Lots 27 and 28, Concession 4, former Darlington Township, east of Regional Road No. 34 (courtice Road), and south of Regional Road No.4 (Taunton Road) . 2 . They are the alignment . . .2 42 R~,CA\>C[LRED R~~~I~CE n-1~ IS Pf1:NTEDCXJ RECYCLED PAPER REPORT NO.: PD-120-93 PAGE 2 3. with respect to the alignment issue, the M.T.O. officials explained that the chosen alignment was based on detailed review and evaluation of all technical factors and judged to be the best alignment from a technical perspective. Subsequent to the Hasiuk's voicing their concern, the M.T.O. commissioned a further investigation on the Hasiuk's property and produced the McCormick Rankin Report which confirms the preferred alignment. The Hasiuks indicated that the alignment would divide the farm and landlock the easterly portion of the property. They suggested the M.T.O. should purchase the farm or at a minimum, to purchase the landlocked portion. 4. M.T.O. officials explained the Ministry's policy of advanced purchase which basically involved the property owner first listing the property on the open market at market value for a period of time. If there is no sale and a hardship situation is established, the Ministry will then consider negotiating wi th the property owner for the purchase of the property. After the property is listed and the hardship is proven as result of lack of offer to purchase because of the location of the technicially preferred route, the Ministry will then consider negotiating with the owner to determine whether the whole farm or the landlocked parcel would be purchased by M.T.O. . The Hasiuk family was previously advised of the Ministry's policy on advanced purchase. 5. During the meeting, there was apparent disagreement among members of the Hasiuk family. At the end, majority family members including Mr. William Hasiuk (father and property owner) agreed to put the property up for sale and follow through with the M.T.O. procedures. Copy of the letter is attached. 6. Members of the Hasiuk family have been notified of the date of the General Purpose and Administration meeting. I, Gerald Hasiuk, am of the opinion the proposed link should follow the abandoned Hancock Road route. This would not upset the social structure of homes, environmentally leave the creek on Pebblestone undisturbed and not damage virgin bush on the proposed route. Agriculturally, the MTO route would devastate top quaility farm land and landlock future agricultural land. Therefore, I can not visualize a road cornering good agricultural land when forty rods over exists an abandoned road. I theref~re will not alternate, which has been is my only logical choice property has been offered accept the proposed route. The endorsed by the Town of Clarington and the fact that the additional nIy s bstantiates my choice.
