Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:

THAT Report PD-115-93 be received;
THAT the application to amend Comprehensive Zoning By-law 84-
63 of the former Town of Newcastle, as amended, submitted by
Ridge pine Park Inc., be referred back to Staff for further
processing pending the receipt of all outstanding comments;
and
THAT the interested parties listed in this report and any
delegation be advised of Council's decision.

2 . BACKGROUND
2.1 On July 12, 1993, the Planning and Development Department
received an application submitted by Ridge pine Park Inc. to

amend Comprehensive zoning By-law 84-63 of the former Town of
Newcastle.
2.2 The subject lands are situated on a 124 hectare (306 acre)
parcel of land located along the Lake ontario Shoreline but is
more formally described as Part Lot 1, 2 and 3, Broken Front
concession, former Township of Darlington, and Part Lot 33, 34
and 35, Broken Front Concession, former Township of Clarke.
3. PUBLIC NOTICE AND SUBMISSIONS
3.1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject
lands. In addition the appropriate notice was mailed to each
landowner within the prescribed distance.
3.2 As of the writing of this report, the Planning and Development
Department has not received any written. submissions. However,
the Planning and Development Department did receive one (1)
telephone inquiry from a wilmot Creek resident requesting more
detailed information with respect to the proposal.
4. OFFICIAL PLAN CONFORMITY
4.1 within the 1976 Regional Official Plan the subject property is
designated as Mobile Home Park with a population allocation of
1500 while the 1991 Regional Official Plan designates the
subject property as a Living Area. The application does not
conform with the 1976 Regional Official Plans which would
allow only mobile homes on the subject property and not single
family dwellings. However, the application would appear to
conform with the Living Area designation in the 1991 Regional
Official Plan.
5. ZONING BY-LAW COMPLIANCE

"Environmental Protection (EP)" and in part "Residential
Mobile Home Park (RM)". The applicant is proposing to:
i) add single detached units as permitted uses,
ii) reduce the required mobile home site area from 325 m2 to
3 00 m2,
iii) permit a 7.5 m setback from lot lines,
iv) permit a 1.0 metre setback for carports from any internal
road.
5.2 Therefore, the applicant has applied to appropriately amend
the zoning by-law.
6. AGENCY COMMENTS
6.1 In accordance with departmental procedures, the application
was circulated to obtain comments from other departments and
agencies. The following provides a brief synopsis of the
comments received to date.
6.2 The Central Lake ontario Conservation Authority advised that
it would be appropriate for the rezoning of the lands to
recognize the development constraints imposed by the potential
flood and erosion hazards within the subject area. Therefore,
the Authority notes that the Environmental Protection (EP)
zone should be placed upon the 78 metre shoreline setback of
the Authority's Shoreline Management Plan. In addition, the
Authority requests that the applicant be required to determine
the extent of the Regional Storm floodplain of the two small
watercourses which traverse the subject lands
6.3 The Ganaraska Region Conservation Authority has also advised
that it would be appropriate to have the Environmental
Protection zone expanded to incorporate the Authority's
current shoreline setback of 81 metres. In addition, the
Authority has requested that the Environmental Protection zone
also be extended to include the flood plain of a small
watercourse between Bluff's Road and Wheelhouse Drive. ....4

6.4 The only other agencies which have responded to the
circulation are the Municipality of Clarington Public Works
Department and Municipality of Clarington Fire Department.
Nei ther of these agencies provided obj ectionable comments with
respect to the subject application. The Waterfront
Regeneration Trust, Ministry of Natural Resources and Regional
Planning Department have all yet to respond to the
circulation.
7. STAFF COMMENTS
7.1 As the purpose of this report is to satisfy the requirements
of the Planning Act with respect to a Public Meeting, and in
consideration. of the outstanding comments, it would be in
order to have the application referred back to Staff for
further processing and the preparation of a subsequent report.
