Subject: REMOVAL OF HOLDING SYMBOL - w. G. DALLAS
PART LOT 18, CONCESSION 8, FORMER TOWNSHIP OF DARLINGTON

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-99-93 be received;
2. THAT the zoning Amendment application submitted by W. G.
Dallas, requesting the removal of the "Holding (H)" symbol
from the subject lands within Part Lot 18, Concession 8, in
the former Township of Darlington be approved;
3. THAT the attached amendment to By-law 84-63 be approved; and
4. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1 . BACKGROUND
1.1 On May 13, 1993, the Planning and Development Department
received an application, submitted by W. G. Dallas, requesting
the removal of the "Holding (H)" symbol from the subj ect lands
located in Part Lot 18, Concession 8, in the former Township
of Darlington.
1.2 Staff note that the lands in question were subject to land
severance application LD 025/93. The land Division Committee
granted approval to the application which would create one (1)
Hamlet Residential lot, subject to various conditions of
approval. One of the Town's conditions of approval required
the removal of the "Holding (H)" symbol.

2. STAFF COMMENTS
2.1 The subject property is presently zoned "Holding - Urban
Residential Type One ((H)R1)". The "Holding (H)" symbol can
be removed by Council upon council being satisfied that the
uses to be permitted will be adequately serviced, have
adequate access and will be used for the purposes intended by
the by-law.
2.2 In reviewing this application, staff is satisfied that the
conditions of removal of the "Holding (H)" symbol have been or
will be met and should be removed to satisfy the condition of
approval as imposed by the Land Division committee. The Town
will secure it's financial requirement such as development
charge prior to the issuance of a building permit.
2.3 In consideration of the comments noted above, Staff would have
no objection to the removal of the "Holding (H)" symbol as
shown on the attached By-law and Schedule.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 93-_
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the
Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable
to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle in
accordance with application DEV 93-014 to permit the development of one (1) residential
hamlet lot.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town
of Newcastle enacts as follows:
1. Schedule "9" to By-law 84-63, as amended, is hereby further amended by
changing the zone category from:
"Holding - Residential Hamlet ((H)RH)" to Residential Hamlet (RH)".
2. Schedule "A" attached hereto shall form part of this By-law.
3. THAT this By-law shall come into effect on the date of the passing thereof, subject
to the provisions of Section 36 of the Planning Act.
