EXEMPTION FROM PART LOT CONTROL - BLOCK 159, 10M-797

It respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-84 -93 be received;
2. THAT the request submitted by David Thomas on behalf of Betty Jo
King for removal of Part Lot Control on Block 159 on Plan 10M-797
be Approved;
3. THAT the attached by-law be approved and forwarded to the Region
of Durham Planning Department pursuant to section 50(7) of the
Planning Act; and,
4. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. BACKGROUND
1.1 Registered Plan of Subdivision 10M-797 is located south of
King street (Highway No.2), west of Prestonvale Road, north
of Glenabbey Drive and east of the Black Creek. The
subdivision consisted of 158 single family dwelling units on
15.0 m minimum frontage lots. The subdivision is complete
in terms of roads and all lots having building permits
issued.
1.2 At the time of Draft Approval, Block 159, of 10M-797,
together with lot 1 was maintained as a possible temporary
access point for the proposed subdivision. In November
1987, Council considered and approved a request by the
developer to relocate the temporary access point to a more

The proponent wishes to divide Block 159 to permit the
development of two semi-detached/link units. Lot 1 of the
Plan 10M-797 was previously built upon when the temporary
access point was relocated southerly.
1.3 The removal of Part Lot Control would facilitate the
construction of a semi-detached/link dwelling unit on Block
159. The process will enable this block to be developed
with a semi-detached/link dwelling and than divided through
the resurveying and deposition of a plan after the dwelling
foundations are in place.
1.4 As the block is contained within a registered plan of
subdivision there is an existing subdivision agreement in
place to cover some of the Town's financial interest,
including the payment of parkland dedication. Payment of
lot levies however will be applicable prior to issuance of
building permit.
1.5 Regional Works Department advised that prior to their
approval, the applicant would be responsible for the payment
of sanitary sewer main frontage charge, water main frontage
charge and water and sanitary sewer connection charge.
These payments were subsequently made during the first week
of May. Regional Works has no objection to further
processing of the subject application.
1.6 Town of Newcastle Public Works Department, Community
Services Department and Fire Department all advised they
have no objection to this proposal. Lot development charges
for the two units are applicable prior to issuance of
building permit.

2.2 Attached hereto is a by-law to exempt the subject lands from
section 50(5) of the Planning Act pursuant to the provlslons
of section 50(7) of said Act. This By-law requires approval
of Council and the Regional Municipality of Durham.
2.3 Once the dwellings are erected and conveyed, Staff will
bring forth a by-law repealing this by-law so that Part Lot
Control will be restored on the subject property in
accordance with the Planning Act.

BY-LAW NUMBER 93-
being a by-law to designate a certain portion of a registered plan
as not being subject to Part Lot Control
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it desirable to exempt from Part Lot Control, Block 159 on
Plan 10M-797 registered at the Land Registry Office for the Land
Registry Division of Newcastle (No. 10).
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of
the Town of Newcastle enacts as follows:
1. THAT Subsection (5) of section 50 of the Planning Act shall
not apply to those lands described in Paragraph 2 within this
By-law.
2. This By-law shall come into effect upon being approved by the
Regional Municipality and thereafter Subsection (5) of Section
50 shall cease to apply to the following lands:
1) Block 159 on Plan 10M-797.
BY-LAW read a first time this day of 1993.
BY-LAW read a second time this day of 1993.
BY-LAW read a third time and finally passed this day of
1993.
