THAT Report PD-50-93 be received; and 2. THAT the Region of Durham be requested to approve the Modification to Amendment No. 40 to the Town of Newcastle Official Plan, as indicated by Attachment No. 1 to this Report; 3. THAT the Region of Durham be further requested to modify Amendment No. 255 to the Durham Regional Official Plan to reflect said Modification to Amendment No. 40; and 4 __THAT__the _Durham Region_ Planning_ Department, _and all interested parties listed in this report and any delegation be advised of Council's decision. 1. BACKGROUND 1.1 Amendment No. 40 to the Town of Newcastle Official Plan extended the boundaries of the Bowmanville Urban Area and the Bowmanville Main Central Area, and identified designations for the subject lands (see Attachment No. 1). Amendment No. 255 to the Regional Official Plan reflected the extensions to the boundaries of the Urban Area and the Main Central Area approved through Amendment No. 40. Both amendments were approved by Regional Council on February 6, 1991. jj ----~ U I ,M1PI.~°i I,E~Yp.~E }}CIS IS PRIMED ~~f,YG LED PM1PFl} REPORT NO. PD-50-93 PAGE 2, 1.2 An 8.8 ha (21.8 acre) parcel of land at the northeast corner of Green Road and Highway 2 was identified by Amendment No. 40 as 'Special Study Area'. However, this parcel of land was not included in the Urban Area or the Main Central Area by either Amendment No. 40 or Amendment No. 255. 1.3 On December 10, 1992, the Ministry of Municipal Affairs referred Amendment Nos. 40 and 255 to the Ontario Municipal Board for a hearing in response to an appeal by the owners of the Bowmanville Mall. Amendment No. 40, as referred, was subject to four modifications proposed by the Ministry. Modification # 3 deleted the lands located at the northeast corner of Green Road and Highway No. 2 from the amendment. 1.4 The lands which the Ministry has proposed to delete from Amendment Nos. 40 and 255 are part of the study area for the Bowmanville Main Central Area Study. The Secondary Plan resulting from the Central Area Study will also be considered at the Ontario Municipal Board Hearing for Amendment Nos. 40 - and 255. -As-such, it is important that-the---subject--.lands be_ considered along with all of the other lands being reviewed through the Main Central Area Study. 1.5 In response to an inquiry by Planning Department Staff with respect to Modification No. 3, Ministry Staff indicated they had no concern with the subject lands being included as 'Special Study Area' provided the Official Plans of Durham and the Town of Newcastle incorporate these ,lands within the urban area. 2. PROPOSED MODIFICATION 2.1 Amendment No. 40 as originally approved by Regional Council, led to the Bowmanville Main Central Area Study currently being undertaken for the Town. PD-50-93 PAGE 3 lands at the northeast corner of Highway No. 2 and Green Road within the Amendment is logical in the consideration of the land uses for the west portion of Bowmanville Main Central Area. The inclusion of these lands is important to the completion of the Main Central Area Study. 2.2 The proposed modifications to Amendment No. 40 are indicated on Attachment No. 2. The modifications would adjust the boundaries of the Bowmanville Urban Area and the Main Central Area to include the lands deleted by the Ministry's modification. 2.3 A modification to Amendment No. 255 to the Regional Official Plan is also required to reflect the subject modification to Amendment No. 40. PROPOSED MODIFICATION TO AMENDMENT NO. 40 TO THE TOWN OF NEWCASTLE OFFICIAL PLAN PURPOSE: The purpose of this Modification is to modify Amendment No. 40 to the Town of Newcastle Official Plan to include all lands designated as "Special Study Area" by the Amendment within the boundaries of the Bowmanville Major Urban Area and the Bowmanville Main Central Area. LOCATION: The lands subject to the Modification are located in Part Lot 16, Concession 1, former Township of Darlington. BASIS: All lands designated as "Special Study Area" by Amendment No. 40 were not included within the boundaries of the Bowmanville Major Urban Area and the Bowmanville Main Central Area. These lands however, are contiguous with and logically support the development of both sides of Highway No. 2. New designations for the "Special Study Area" lands are currently under study and will be incorporated into the recommendations of the Bowmanville Main Central Area Study. ..ACTUAL MODIFICATION: Amendment No. 40 to the Town of Newcastle Official Plan is hereby modified as follows: 1.
