Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETING OF FEBRUARY 11, 1993

It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-40-93 be received;
2. THAT Council concur with the decision of the Committee of
Adjustment made on February 11, 1993; and
3. THAT Staff be authorized to appear before the Ontario
Municipal Board to defend the decisions of the Committee of
Adjustment in the event of an appeal.
1. BACKGROUND
1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990,
all applications received by the Town for minor variance are
scheduled to be heard within 30 days of being received by the
Secretary Treasurer. On February 11, 1993 the Committee
APPROVED the one (1) application on the agenda.
1.2 Application A 93/001 proposed to vary the EXTERIOR side yard
setback requirements of the Town's Comprehensive Zoning By-law
to permit the applicant to legalize an existing dwelling which
has been constructed with a side yard setback of 12.8 metres
(42 feet), instead of the minimum required 15 m (49.2 feet).
1.3 Staff have reviewed the Committee's decision and are satisfied
that the decision conforms to the general intent of the
Official Plan and the Zoning By-law and that the variances
sought are minor in nature. •••2

1.4 Council's concurrence with the Committee of Adjustment
decision is required in order to afford Staff's official
status before the Ontario Municipal Board in the event of an
appeal of the decision of the Committee of Adjustment.
