THAT Report PD-37-93 be received; 2. THAT application to amend the Town of Newcastle Comprehensive Zoning Byu-law 84-63, as amended, submitted by Ronald Sucee on behalf of Tanglewood Stables be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the Durham Region Planning Department, and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Ronald Sucee 1.2 Owner: Tanglewood Stables 1.3 Rezoning: From Agricultural Exception (A-1) to a zone appropriate to permit the creation of a 371.6 square metre place of worship 1.4 Area: 1.64 hectares 2. LOCATION 2.1 The subject property is located within Part of Lot 17, Concession 6, former Township of Darlington. More specifically, the site for the proposed place of worship is located just north of Concession Road 6, on the west side of Regional Road 57. ....2 J i I I I REPORT NO. PD-37-93 PAGE 2 I I~ 3. BACKGROUND 3.1 On December 17, 1992 an application to amend the Town of Newcastle Comprehensive Zoning By-law, 84-63 as amended, was received. The applicant proposes to rezone the subject lands to permit the erection of a 371.6 square metre place of worship. 4 EXISTING AND SURROUNDING USES 4.1 Existing Uses: Race horse training facilities and a single detached dwelling. 4.2 Surrounding Uses: East - existing residential West - vacant agricultural South - agricultural and existing residential North - existing residential and horse race track facilities 5. OFFICIAL PLAN POLICIES 5.1 In both the 1976 and 1991 Durham Region Official Plan, the subject lands are designated "Permanent Agricultural Reserve". The predominant use of lands so aesignated 51~a1i be f-or ugri~ultu-r-a-1 and farm related purposes. However, Section 6.2.6 of the 1976 Official plan states that regardless of designation, a place of worship may be permitted in any area provided that the facility is compatible with the surrounding land uses. However, if the proposed use would be in conflict with the predominant use permitted in that designation, the proposed use shall be discouraged to locate at that site. The 1991 Plan in Section 5.2.1, has a similar provision, stating that the use be visible and accessible to residents and is "preferably in close proximity to existing and future transit routes". Comments regarding conformity with the Durham Region Official Plan have not yet been received from the Region's Planning Department. 6 ZONING BY-LAW PROVISIONS 6.1 According to the Town of Newcastle Comprehensive [,t~tiiiiy ;may-lava ~4--------- ....3 i1 ~~i JvL. REPORT NO. PD-37-93 PAGE 3 63, as amended, the subject lands are zoned "Agricultural Exception (A-1)". Lands so zoned shall be for farm purposes. As a place of worship is not permitted under the "A-1" provisions, this application for amendment to the Zoning By-law is necessary. 7 PUBLIC MEETING AND SUBMISSION 7.1 Pursuant to Council's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 7.2 As of yet, no written submissions have been made either in support or in opposition to this proposal. 8 AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Community Services Town of Newcastle Fire Department Durham Region Health Department Ministry of Agriculture and Food 8.2 The Central Lake Ontario Conservation Authority stated that the site is located in an important local groundwater recharge area and that there are groundwater discharge areas located south of the site and a Bowmanville Creek tributary exists east of these lands. As such, the Conservation Authority noted concern that an additional septic system in the area may impact the groundwater. In order to satisfy the Authority they require additional information to be provided. They ask that the information demonstrates that the existing conditions can support the use proposed and that the system will not adversely impact either the groundwater quality or the water quality of the stream. ....4 (J i REPORT NO. PD-37-93 PAGE 4 Ij 8.3 Comments have yet to be received from the following agencies: Town of Newcastle Public Works Durham Region Planning Department Durham Region Works Department Ministry of Transportation Ministry of Natural Resources Ontario Hydro 9 STAFF COMMENTS 9.1 Staff note that the applicant has been asked to provide a geotechnical report which will verify whether the site can support private services for the proposed place of worship. A copy of this report will be provided to the Conservation Authority for their review and comment. 9.2 It is Staff's understanding that if this rezoning application is approved, a severance application to create the lot will be submitted to the Land Division Committee. Staff note that an application for a site plan agreement must also be made prior to construction of the proposed place of worship. 10 CONCLUSION 10.1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff to indicate issues or areas of concern regarding the subject application. It is recommended the application be referred back to Staff for further processing and subsequent report upon resolution of the above issues and receipt of all outstanding comments and required revisions. . ~ J `t' REPORT NO.
