It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Re ort PD-
P 25 -93 be received;

2• THAT the application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, submitted by
John Mago on behalf of the Hungarian Culture Club, in order to ~
permit the establishment of a 190.26 square metre picnic
grounds shelter be CLOSED; and
3• THAT the interested parties listed in this report and an
delegation be advised of Councils decision. y

2. BACKGROUND
2.1 The Hungarian Culture Club, which owns the subject property,
has used the lands for recreational purposes since 1951.
Early in 1990, a 190.26 square metre picnic grounds shelter
was destroyed by fire. Since the current zone category did
not recognize the existing use of the property, the shelter
enjoyed a legal non-conforming status. However, once the
shelter was destroyed by fire the legal-non-conforming status
was lost. Therefore, in order to re-establish the shelter,
the Hungarian Culture Club applied to amend the Town's
Comprehensive Zoning By-law.
2.2 On November 12, 1990, the Council of the Town of Newcastle
approved Resolution # GPA-771-90 that the zoning amendment be
approved in principle and that the necessary by-law be passed
following the execution of a site plan agreement between the
municipality and the applicant.
2.3 The Regional Works Department reviewed the proposal and
advised the municipality and the applicant that-they had no
objections to the proposal subject to the following
conditions:
i) that the applicant, at his full cost, close the existing
entrance (including the removal of the existing culvert)
and build a new 6.0 metre (minimum) wide entrance at a
location 150.0 metres to the south of the present
entrance. This will ensure that the minimum safe sight
distance is available for vehicles exiting the property;
and
ii) that the applicant dedicate to the Region of Durham, free
and clear of all encumbrances, a 3.0 metre wide road
widening across the entire frontage of the subject
property abutting Regional Road No. 57.

2.4 The applicant was reluctant to provide the widening and
relocate the driveway and as a result, the applicant never
finalized the site plan. In December of 1992, the applicant's
solicitor withdrew the application.
3. CONCLUSION
3.1 In consideration of the comments contained within this report
and in consideration of resolution # GPA-771-90, Staff
recommend that the zoning amendment application be CLOSED.
