THAT Report PD-13-93 be received; 2. THAT the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, submitted by William Kraayvanger~ on behalf of Kraco contracting in order to permit the development of the subject lands with a duplex, be DENIED; and 3. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Kraco Contracting 1.2 Owner: william Kraayvanger 1.3 Rezoning: from "Agricultural Exception (A1)" to an appropriate zone category in order to permit the development of the subject parcel with a 204.38 square metre (2200 square foot) duplex. 1.4 Area: .47 hectare (1.16 acres) ....2 531 RECYCLED PAI'IER PAPER I1ECYCLE REPORT NO. BACKGROUND 2.1 In February of 1991, the Town of Newcastle Planning and Development Department received an application filed by William Kraayvanger on behalf of Kraco Contracting, to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, in order to permit the construction of a 204.38 square metre duplex. 2.2 The subj ect property is an irregular shaped parcel, .48 hectare (1.16 acres) in size, located on the north side of Metcalf street, approximately 60 metres (200 feet) east of Mill street but is more formally described as Part Lot 27, Concession 1, in the former Township of Clarke. 2.3 A Public Meeting with respect to the application was held on April 22, 1991 at which time the applicant addressed the Gen~ral Purpose and Administration Committee. However, no other area resident appeared before the Committee either in opposition to or in support of the application. 3. PUBLIC NOTICE AND SUBMISSIONS 3.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner within the prescribed distance. 3.2 As a result of the public notification process, the Planning and Development Department has received two (2) written submissions from area residents who expressed concern over the possible negative impact of the proposal on the surrounding area. . . . . 3 532 REPORT NO. OFFICIAL PLAN CONFORMITY 4.1 within both the existing and recommended Regional Official Plans, the subject property is designated as Permanent Agricultural Reserve. section 11.3.7 of the existing Regional Official Plan and section 20.11.1 of the recommended Regional Official Plan would'permit the erection of one (1) single family dwelling on existing lots of record. Therefore, in order to permit the development of the subject property. with a two family dwelling, the applicant will have to file an application with the Regional Municipality of Durham to amend the Regional Official Plan. 5. ZONING BY-LAW COMPLIANCE 5.1 within the Town of Newcastle Comprehensive Zoning By-law 84- 63, the subject property is zoned Agricultural Exception (A- 1). As the applicant proposes to develop the subject property with a two family dwelling, the applicant has applied to amend the zoning by-law accordingly. 6. AGENCY 6.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following provides a brief synopsis of the comments received. 6.2 The Ministry of Agriculture and Food has reviewed the proposal in terms of the goals and objectives of the Food Land Guidelines. The Ministry has advised that although the Food Land Guidelines highly discourage non-farm residential uses in agricultural areas, the Ministry has not objected to single family residential uses in agricultural areas. However, the Ministry advises that the Food Land Guidelines do no advocate mUlti-family residential uses in agricultural areas and the Ministry therefore objects to the proposal. 533 REPORT NO. PD-13-93 PAGE 4 6.3 The Community services Department has advised that they have no objection to the application subject to the parkland dedication requirement being accepted as cash-in-lieu with the funds realized being credited to the Parks Reserve Account. 6.4 The balance of the circulated agencies which have provided comments were the Town of Newcastle Public Works Department, Town of Newcastle Fire Department and Ganaraska Region Conservation Authority. None of the aforementioned agencies provided objectionable comments with respect to the proposed zoning by-law amendment. 7. STAFF COMMENTS 7.1 Staff have reviewed the application in relation to the Regional Official Plan, Town of Newcastle Comprehensive Zoning By-law 84-63 and the comments received through the circulation and public notification processes. As previously noted, the Ministry of Agriculture and Food has advised that the proposal does not comply with the Food Land Guidelines. 7.2 In addition to the comments from the Ministry of Agriculture and Food, the application does not conform with the provisions of the Durham Regional Official Plan. Furthermore, the applicant was notified in June of 1991 that an amendment to the Regional Official Pl~n was required. However, as of the writing of this report, the applicant has not made the appropriate application with the Regional Planning Department. 8. CONCLUSION 8.1 In view of the comments contained within this report, Staff recommend that the application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63 be DENIED. ....5 f.'" 4 Jj .
