THAT Report PD-5-93 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on December 3 and 17, 1992; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1. BACKGROUND 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received._by the Town for minor _.variance._are scheduled to be heard within 30 days of being received by the Secretary Treasurer. On December 3, 1992, the Committee considered eleven (11) applications, APPROVING ten (10) and denying one (1). On December 17, 1992, one application was heard and APPROVED. 1.2 Application A 92/061 proposed to vary the lot frontage requirements for a semi-detached/link lot from 18m to 16.76m. Staff did not consider the variance minor in nature or desirable. The Committee agreed with this position and DENIED the application. 1.3 Applications A92/062 to A92/070 inclusive proposed to legalize townhouse blocks which were constructed having a frontage of 5.95m instead of the minimum required 6.0 metre. • A~ ~ Fl g Rt~~r~~~E ~}~~515 FlRINTEO GN PEUYCLEU PAPER REPORT NO.: PD-5,93 PAGE 2 1.4 .Application A92/060 and A92/071 were both for variances to permit accessory buildings larger than 40% of the main building floor area. In both instances, the Committee APPROVED the proposed variances subject to removal of existing buildings. 1.5 Staff have reviewed the Committee's decision and are satisfied that the decision conforms to the general intent of the Official Plan and the Zoning By-law and that the variances sought are minor in nature and desirable for the development of the area. 1.6 Council's concurrence with the Committee of Adjustment decision is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment.
