THAT Report PD-114-92 be received; THAT application to amend the Town of Newcastle Comprehensive Zoning by-law 84-63, as amended, submitted by Antonio Checchia be referred back to Staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and THAT any delegation and those persons listed in this report be advised of Council's decision. 1. 1.1 1.2 1.3 APPLICATION DETAILS Applicant: Owner: Rezoning: Antonio Checchia Mr. & Mrs. Checchia From Urban Residential Exception (Rl-19) to a zone appropriate to permit the creation of two residential lots. 0.37 ha (0.9 acres) 1. 4 Area: 2 . LOCATION 2.1 The subject lands are found in Part of Lot 35, Concession 3, former Township of Darlington, with the municipal address being 233 Townline Road North (Regional Road 55). PD-114-92 PAGE 2 3 BACKGROUND 3.1 In 1991 Mr. Checchia submitted a rezoning application to permit the creation of two residential lots. On the 27th of January 1992, the Town of Newcastle Council passed by-law 92-039 approving the creation of two new residential lots having a minimum lot frontage of 12 metres on the subject lands. 3.2 On March 30, 1992, the Planning Department received a second application to amend the Town of Newcastle comprehensive zoning By-law 84-63, as amended, to permit the creation of an additional two residential lots for single dwelling units. If this application is approved than what was once a single residential lot will be divided into a total of 4 single dwelling unit lots. 4 EXISTING AND SURROUNDING USES 4.1 Existing Uses: Existing Single Dwelling unit 4.2 Surrounding Uses: East - Draft Approved Plan of Subdivision for 38 Single.......Dwelling units (18T-S91:1:-5) West - South - North - vacant Existing Single Dwelling units Recently approved rezoning application to permit the creation of two single dwelling lots, and existing Single Dwelling units 5 OFFICIAL PLAN POLICIES 5.1 According to the 1976 Durham Region Official Plan, the subject site is located within the "Residential Areas" designation with an indication of hazard lands. The precise extent and limit of the Hazard Lands will be determined 'through comments from the Central Lake ontario Conservation Authority. The 1991 Council approved Regional Official Plan designates the lands as "Living Area". ....3 510 REPORT NO. PD-114-92 PAGE 3 5.2 As depicted on Schedule 6.1 of the Town of Newcastle Official Plan, the lands are situated within a "Residential" designation. Lands so designated shall be used for predominantly residential purposes. 6 ZONING BY-LAW PROVISIONS 6.1 The subject site is zoned "Urban Residential Exception (R1- 19)". This zone permits residential development on a lot with a minimum lot area of 1700'square metres. The applicant has applied to permit the creation of residential lots having a minimum frontage of 12 metres (40 feet). 7 PUBLIC MEETING AND SUBMISSION 7.1 Pursuant to Council's Resolution of July 26, 1982 and the requirements of the Planning Act the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. . .. .... 7;2 . . At-th-e--time-of-writing-,--=there........have........been........no..___quest-ions-:--or concerns expressed by any residents. 8 AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. The following departments/agencies in providing comments, offered no objection to the application as filed: Town of Newcastle Fire Department Durham Region Health unit Ministry of Natural Resources ontario Hydro 8.2 The Town of Newcastle Public Works Department had no ....4 5 1 1 REPORT NO. However, detailed comments will be made when the required consent applications have been made. 8.3 The Town of Newcastle Community services Department has requested that the applicant provide 5% cash-in-lieu of parkland with the funds being credited to the Park Reserve account. The monies will be collected prior to fulfilment of the conditions of any subsequent severance. 9 COMMENTS 9.1 The applicant has requested to amend the by-law to permit the creation of two residential having a minimum frontage of 12 metres (40 feet). Due to the location of the existing residence, Staff note that prior to the creation of these two lots, all structures must be demolished. 9.2 Staff examined the existing lot frontages abutting this site and the proposed lot frontages of the draft approved sUbdivision to toe east.. of~the~subj-ee-t. l-anGc. 'I'hEa-c-maj.orit~ of lots in the draft approved subdivision have frontages of 12 metres to 15 metres. 9.3 The applicant will be required to apply to the Land Division committee to create the two new lots. It is apparent from the circulation that a number of the agencies will impose their requirements as conditions to be satisfied prior to clearance of the consent applications. 10 10.1 CONCLUSION The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and council with some background on the ....5 51 (~ REPORT NO. PD-114-92 PAGE 5 application submitted and for Staff to indicate issues or areas of concern regarding the subject application. It is recommended the application be referred back to Staff for further processing and at such time as all outstanding comments have been received and agencies satisfied, a report will be forwarded to committee/Council for consideration.
