MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT
FOR THE MEETINGS OF APRIL 30 AND MAY 7, 1992

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-124-92 be received; and
2. THAT Council concur with the decisions of the Committee of
Adjustment made at its meetings of April 30 and May 7, 1992.
3. THAT Staff be authorized to appear before the ontario
Municipal Board to defend the decisions of the Committee of
Adjustment in the event of an appeal.
1. BACKGROUND
1.1 In accordance with section 45 of the Planning Act R.S.O. 1990,
all applications received by the Town for minor variance are
scheduled to be heard within 30 days of being received by the
Secretary Treasurer. Meetings of the Committee of Adjustment
were scheduled for April 30, 1992 and May 7, 1992.
1.2 On April 30, 1992, two (2) applications for minor variance
were heard by the Committee (A92/022 and A92/023). Both were
to permit accessory structures on a residential lot in excess
of 40 % of the main building floor area. Application A92/023
was APPROVED, while A92/022 was TABLED to allow the applicant
time to resolve staff's concerns.
1.3 Application A92/022 was filed as a result of staff's comments
on a related land severance application (LD 92/041). The

consent application was to permit a retirement lot for a bona-
fide farmer. The retirement lot was proposed to retain the
farm buildings having a total coverage of 461 m2 (4970 sq.
ft.) as opposed to the maximum permitted 66. 0 m2 (715 sq.
ft. ). Staff did not support the variance application as being
minor in nature and in keeping with the intent of the zoning
by-law provisions. The minor variance application was TABLED
and will be reheard May 28, 1992.
1.4 On May 7, 1992, three (3) applications for minor variance were
considered. Application A92/025 was TABLED as per staff's
recommendation due to a revision to the proposal by the
applicant. Application A92/026 was TABLED to allow the
applicant to address the drainage concerns raised by the
Public Works Department and Central Lake ontario COnservation
Authority. Application A92/024 was APPROVED as applied for.
1.5 Staff have reviewed the balance of the Committee's decisions
and are satisfied that the decisions to approve conform to the
general intent of the Official Plan and the Zoning By-law and
that the variances sought are minor in nature and desirable.
Council's concurrence with the Committee of Adjustment
decisions is required in order to afford Staff's official
status before the ontario Municipal Board in the event of
appeal of the decisions of the Committee of Adjustment.
