DEVELOPMENT CHARGE POLICIES
EXEMPTION TO SEASONAL TRAILERS FOR FARM WORKERS

Recommendations:
It is respectfully recommended to Council the following:
1. THAT Report PD-133-92 be received;
2. THAT in accordance to section 8 of the Development Charges
Act, the Development Charge Policies Report as approved by
Council on March 2, 1992 is amended by adding the following
new section 2.8.2.5 as follows:
"section 2.8.2.5
Seasonal Trailers for farm workers:
THAT exemption for payment of development charges be
granted to seasonal trailers for farm workers subject
to the owner providing a Letter of Undertaking to the
Town agreeing that the seasonal trailers would not be
resided upon by any person other than farm workers on a
seasonal basis."; and
3. THAT Mr. Kirk Kemp be advised of Council's decision.
REPORT:
1. Mr. Kirk Kemp approached the Department with respect to
applying for a building permit to place a trailer on his
farm for farm workers to harvest his apple crop.
2. During processing of his building permit application, Mr.
Kemp was advised that the Town development charge levy would
apply. Mr. Kemp has apparently written to the Mayor and
Members of Council requesting for an exemption.

3. Under section 8 of the Development Charges Act, an owner may
complain in writing to the Council in respect to the
development charge imposed by the municipality and the
Council shall hear such complaint. In order to ensure
compliance with the Development Charges Act, Staff is
treating Mr. Kemp's concern pursuant to section 8 of the
Act.
4. Subsequent to our review of Mr. Kemp's situation, Staff
concluded that it was not the intent of the Development
Charges Policies to impose charges on seasonal trailers for
farm workers. To correct the situation, Staff suggest that
the Policies Report be amended by adding a new exemption for
seasonal trailers for farm workers. In order to ensure that
the seasonal trailer would not be used or rented out on a
year-round basis, it is further recommended that the owner
shall provide a Letter of Undertaking to such effect. If
approved, the amendment would solve Mr. Kemp's problem as
well as providing a clear cut policy for all similar
situations in the future.
