BY-LAW ENFORCEMENT

Recommendations:
It is respectfully recommended to Council the following:
1. THAT Report PO-141-92 be received; and
2. THAT direction of Council is requested.
REPORT:
1. At its meeting held on May 25, 1992, Report PO-123-92 was
tabled and referred back to staff to review the possibility
of allowing Mr. MacLean a maximum of six (6) months to
relocate his carpet warehouse and that the zoning by-law not
be enforced within this time period.
2. Mr. MacLean currently operates a carpet warehouse in an
oversized garage on the property which is subject to the
rezoning application. The current use is in contravention
to the Town's Zoning By-law. Since Mr. MacLean has filed a
rezoning application, the By-law Enforcement Officer has not
taken any further action pending the outcome of Council's
decision on the rezoning application. Should Council
endorse the General Purpose and Administration committee
recommendation to deny the rezoning application, Staff will
proceed to lay charges.

3. Any decision by council not to initiate any by-law
prosecution action against Mr. MacLean for a period up to
six (6) months to allow him to relocate his warehouse
operation is a policy decision which Council has to decide.
staff would like to point out that precedence was
established by previous council in the stewart Wood case,
where Council allowed Mr. Wood two (2) years to relocate his
trucking operation.
4. The options available to council are:
a) endorse the recommendation of the General Purpose
and Administration Committee of May 19, 1992
approving the staff recommendation of Report PD-
123-92; or
b) amend the General Purpose and Administration
Committee recommendation by adding the following:
"That there shall be no zoning by-law
enforcement for a maximum period of six (6)
months to allow Mr. MacLean to relocate his
carpet warehouse operation."
