THAT Report PD-144-92 be received; 2. THAT the application to amend the Town of Newcastle Comprehensive zoning By-law 84-63, as amended, submitted by The Lions Club of Bowmanville, be referred back to staff for further processing and the preparation of a subsequent report upon receipt of all outstanding comments; and 3. THAT the interested parties listed in this report and any delegation be advised of Council's decision. 1. 1.1 BACKGROUND Applicant: Agent: The Lions Club of Bowmanville Ron strike 1.2 Rezoning Application: From Urban Residential Type One (R1) to an appropriate zone to permit the continuation of an existing legal non-conforming use. 1.3 Area: 1.3 ha (3.2 acres) 2. LOCATION 2.1 The subject property is located in Part Lots 11 and 12, Concession 1, former Town of Bowmanville. BACKGROUND 3.1 On April 16, 1992, the Town of Newcastle Planning Department received an application to amend the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, to legalize an existing legal non-conforming community centre. 4. EXISTING AND SURROUNDING USES 4.1 Existing Uses: 1115 m2 community centre 4.2 Surrounding Uses: East - Residential West - Institutional/Residential South - Residential North - Residential 5. OFFICIAL PLAN POLICIES 5.1 Under the Town of Newcastle Official Plan for the Bowmanville Urban Area the subj ect property is designated as "Residential" and falls within Neighbourhood lB. The Residential policies allow for a variety of housing styles, types and tenure. section 7.2.1.2 ii) (c) of the Official Plan also permits certain "public recreational and community uses' which are .. . \, compatlble wlth the surroundlng uses. 5.2 Under the current Durham Region Official Plan, the subject property is designated "Residential". The predominant use of lands so designated shall be for housing purposes. As well, section 8.1.2.1 a) of the Durham Region Official Plan permits "certain public and recreational uses, and community uses. . .". 5.3 Under the Durham Region Official Plan, as adopted by Regional Council on June 5, 1991, the subject property is designated "Main Central Area". Lands so designated shall be focal points of activity which would include such uses as "housing, employment, recreational, social activities and cultural facilities", as defined by section 9.1.4. '. ZONING 6.1 The property is currently zoned "Urban Residential Type One (R1) which permits single detached units, semi-detached/link units, and/or duplex units, along with limited home occupation uses. In operation since 1946, the property currently has a legal non-conforming status as it predates both the existing Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, and the former Town of Bowmanville's By-law 1587. 7. PUBLIC NOTICE AND SUBMISSIONS 7.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. As of the writing of this report, no written submissions have been received. 8. AGENCY COMMENTS 8.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. To date, comments remain outstanding from the Town 0+ Newcastle Public Works and Community services Departments, and the Regional Planning Department. The following department/agencies in providing comments, offered no objection to the application as filed: · Town of Newcastle Fire Department · Town of Newcastle Building Department 9. STAFF COMMENTS 9.1 The purpose of this application is to rezone the Lions Club property to recognize the existing use which predates all existing applicable by-laws. The Lions Club currently serves a variety of functions ranging from a meeting place for the Canadian Cancer Society to providing nursery school facilities to local workers and residents. The applicant wishes have a ~ J09 REPORT NO.: PD-144-92 PAGE 4 10. 10.1 proper zoning function will on the land to ensure that its community be able to continue if confronted with circumstances beyond their control. Rezoning of the property would also allow greater ease in the acquisition of dispensations such as property insurance. CONCLUSION The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff to indicate issues or areas of concern regarding the subject application. It is recommended that the application be referred back to Staff for further processing and a subsequent report be presented upon the completion of the above mentioned related applications and the receipt of all outstanding comments.
