It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-190-92 be received;
2. THAT the application to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63, as amended, submitted by
Lorne and Jo-Anne Mehring, to permit the severance of the rear
portion of the lands for future development purposes, be
APPROVED;
3. THAT the attached amending By-law be APPROVED; and
4. THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Lorne and Jo-Anne Mehring
1.2 Rezoning: From Agricultural (A) to an appropriate zone
or zones in order to permit the severance of
the rear portion of the lands for future
development purposes.
1.3 Area: 1.37 hectares (3.39 acres)
2. BACKGROUND
2.1 On April 13, 1992, the Town of Newcastle Planning and

Development Department received an application to amend Zoning
By-law 84-63 in order to permit the severance of the rear
portion of the subject lands for future development purposes.
2.2 The proposal is situated on a 1.37 hectare (3.39 acre) parcel
of land located on the west side of Varcoe Road, approximately
425 metres (1400 feet) north of Nash Road but is more formally
described as Part Lot 35, Concession 3, in the former Township
of Darlington.
3. PUBLIC NOTICE AND SUBMISSIONS
3.1 Pursuant to Council's resolution of July 26, 1982 and the
requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject
lands. In addition the appropriate notice was mailed to each
landowner within the prescribed distance.
3.2 As a result of the public notification process, the Planning
and Development Department has not received any written
submissions with respect to the subject application. However,
Staff have received one (1) telephone inquiry from an abutting
property owner who requested more detailed information
regarding the proposal.
3.3 A Public Meeting with respect to the proposed Zoning By-law
Amendment was held on Monday, June 15, 1992. No one spoke in
opposition to the proposal.
4. OFFICIAL PLAN CONFORMITY
4.1 Within the existing Durham Regional Official Plan the subject
property is designated Residential while the recommended
Regional Official Plan designates the subject property as a
Living Area. Policies 16.9.9 and 16.9.10 of the existing plan

and Policy 20.7.6 of the recommended plan permit the severance
of "landlocked" parcels if an overall development plan has
been prepared. The Town has prepared and adopted the Courtice
West Neighbourhood Development Plan and therefore the proposal
can be considered to be in conformity with the existing and
the recommended Regional Official Plan.
4.2 Within the Town of Newcastle Official Plan, the subject
property is designated Residential. As residential uses are
intended to be the predominant use of lands so designated,
the proposal conforms with the intent of the Town of Newcastle
Official Plan.
5. ZONING BY-LAW COMPLIANCE
5.1 Within the Town of Newcastle Comprehensive Zoning By-law 84-
63, as amended, the subject property is zoned "Agricultural
(A)" which requires a minimum of 100 metres of frontage and
40 hectares of lot area for newly created non-farm residential
lots. Therefore, the applicant has applied to amend the
zoning by-law in order to permit the severance of the existing
single family dwelling. The severance would create a
"landlocked" parcel for future development.
6. AGENCY COMMENTS
6.1 In accordance with departmental procedures, the application
was circulated to obtain comments from other departments and.
agencies. The following provides a brief synopsis of the
comments received to date.
6.2 The Community Services Department has reviewed the proposal
and advises that they have no objection to the application
subject to the cash-in-lieu of parkland dedication requirement
being imposed through the subdivision approval stage for the
landlocked parcel. ....4

Department, Regional Works Department and Central Lake Ontario
Conservation Authority. None of the aforementioned agencies
have provided objectionable comments with respect to the
proposal.
7. STAFF CONIlKENT5
7.1 The applicant proposes to amend the Town of Newcastle
Comprehensive Zoning By-law 84-63 in order to permit the
severance of the rear portion of the subject lands. The
severance is intended to facilitate a .future land assembly for
future residential development through a plan of subdivision.
The severance would create a "landlocked" parcel although the
applicant has not'as yet made an,application for consent.
7.2 Section 16.9.9 and 16.9.10 :of the Durham Region Official Plan
permits the creation of landlocked parcels related to land
assembly provided there is an overall plan detailing the
limits of the land assembly required and the proposed points
of access. -Staff advise that the Town has prepared the
Courtice West Neighbourhood Development Plan and therefore,
the application conforms with Sections 16.9.9 and 16.9.10 of
the Regional Official Plan.
8. CONCLUSION
8.1 In consideration of the comments contained within this report,
the Planning and Development .Department would have no
objection to the approval of 'the attached zoning by-law
amendment, as applied for. The amending zoning by-law would
provide for an appropriate zone category in order to
facilitate the severance of the rear portion of the lands
through the consent process.: ....5

being a By-law to amend By-law 84-63, the Comprehensive Zoning By-

law for the CorX~oration of the Town of Newcastle.
WHEREAS the Cou~icil of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of t:he Town of Newcastle.
NOW THEREFORE Bps' IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. Schedule "~4" to By-law 84-63 as amended, is hereby further
amended by chant{ing the zone designation from:
"Agricultural (P.)" to "Urban Residential Type One (R1)"
2. Schedule °A," attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of the passing
hereof, subject to the provisions of Section 34 of the Planning
Act.

BY-LAW read a third time and finally passed this day of
1992.
