RECOMN~ENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-86-87 be received; and
2. THAT the Region of Durham be advised that the Town of Newcastle has no objections to
the approval of Plan of Condominium 18CDN1-87-002.
BACKGROUND AND COMMENT:
On January 26, 1y87 Planning Staff received a copy of an application filed with the Region
of Durham Planning Department by Mario Veltri and Son Limited for consideration of a Plan
of Condominium, File: 18CDM-87-002.
As Committee may recall the applicant has previously submitted and received the
appropriate approvals for an Official Plan Amendment (File: 85-51/NB) and Rezoning
Application (File: DEV 85-36) to permit the development of a thirty-three (33) unit
apartment building. In consideration of the applicant's intentions to develop a
condominium complex, the Development Agreement between the Town of Newcastle and Veltri

and Son Limited acknowledged the applicant's intentions of filing an
application for the registration of said lands under the provisions of
the Condominium Act. To that end Staff would note that the Development
Agreement, consistent with Town policies, incorporated additional
provisions i.e., the payment of cash-in-lieu of parkland, pursuant to the
provisions of the Planning Act and in consideration of the Condominium Act.
Staff would note for the Committee's information that at the time of
preparation of said report, the Solicitor on behalf of the applicant has been
requested to register the Development Agreement on title. Accordingly and in
consideration of the provisions within the Agreement pertaining to the
issuance of permits, Staff would have no objections to the approval of the
Plan of Condominium application as filed and recommend that the Region be so
advised.
