RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-10-87 be received; and
2. THAT Staff be authorized to amend the application to conform with the current
Regional Policy regarding Clusters and that Staff bring forward a recommendation at
the earliest possible opportunity.
BACKGROUND:
On 1~iay 29, 1986, the Planning Department received an application from Mr. J. Victor, Q.C.
on behalf of Mr. E. Collins to permit the development of one (1) additional residential
lot.
On July 21, 1986, the Planning Department presented a Report PD-190-86 and Council passed
the following resolution:
"THAT the application submitted by Mr. J. Victor, Q.C. on behalf of Mr. Collins,
to rezone a parcel of land located in Part of Lot 18, Concession 2, former Township
of Darlington to permit the development of one (1) additional lot be tabled to
afford the applicant the opportunity for further dialogue with the Central Lake
Ontario Conservation Auti~ority Staff in consideration of the policies within the
Durham Regional Official Plan pertaining to "Environmentally Sensitive Lands."

After discussions had resolved the problems which the Conservation Autho rity
had, Report PD-247-86 was presented to the General Purpose and
Administration Committee on October 20, 1986. The following resolution was
approved:
"THAT the application submitted by Mr. J. Victor, Q.C., on behalf
of hlr. E. Collis , to rezone a parcel of land located in Part of Lot
18, Concession 2, former Township of Darlington to permit the
development of one (1) addi ti oral resi denti al 1 of be approved and
that the by-law attached hereto be forwarded to Council for
approval."
On Monday, October 27, 1986, Council approved the rezoning application.
Staff had recommended approval based upon the past practice of approving
"Rural Cluster (RC)" zones. This entailed recognizing only the area to be
developed.
The three options available at this time are:
i) take the appeal to the Ontario Municipal Board;
ii) revise the application to conform to current Regional Policy; and
iii) repeal the by-law and deny the subject application.
Staff prefers to proceed with the second option since both Staff and Council
supported the application. The Region's amendment to the Official Plan
requires the recognition, within the Zoning By-law, of a number of
residential lots as a Cluster. In this case, it appears to be feasible to
* make such a delineation. The attached key plan outlines the area which
Staff is proposing for the amended application. The amendment will be to
rezone seven (7) lots as a Cluster.
If the recommendations are adopted, Staff will proceed to process the
revised application. This will include a full circulation to owners within
120m and technical agencies previously circulated. Another public notice
will be posted and a public meeting held. This will be treated as though a
new application was filed.

It is therefore recommended that Council authorize Staff to process the
revised application in order to respond to the Region's appeal.
