TENDER NW90-36, WESTVIEW PARK DEVELOPMENT
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. That Report TR-85-90 be received;
2. That Oshawa Garden Service Ltd., Oshawa, Ontario, with
a bid in the amount of $67,713.82 being the lowest
responsible bidder meeting all terms, conditions and
specifications of Tender NW90-36, be awarded the
contract for Westview Park Development, as required by
the Department of Community Services; and
3. That the funds in the amount of $68,500.00 be drawn
from the Community Services Capital Budget Account
#7603-00001-0516; and
4. That the additional funds required in the amount of
$4,213.82 ($67,713.82 contract plus $5000.00 consulting
less $68,500.00 budget allocation) be drawn from the
Community Services Lot Levy Account #1110-156-X.
BACKGROUND AND COMMENT:
Tender specifications were provided by Daniel J. O'Brien and
Associates Ltd., for Westview Park Development, as required by
the Department of Community Services.
Tenders were publicly advertised in all four (4) area newspapers.

Subsequently, tenders were received and tabulated as follows:

The tender submission from Kamstra Landscaping was rejected as an
"Agreement to Bond" as stipulated in the specifications was not
submitted. In accordance with Purchasing By-Law #82-96, failure
to submit this documentation will result in tender rejection.
As provided for in the tender specifications, the Town of
Newcastle reserved the right to increase or decrease the total
contract by 25% without invalidating the unit prices submitted.
As the total tender price was over the total budget allocation of
$68,500.00, discussions were held between the Consultant,
Community Services and Oshawa Garden Service Ltd., in an effort
to bring the total project within budget. The reduction in
quantity of various items such as the walkways, trees and paving,
has reduced the total contract price to $67,713.82.
Additional costs associated with this project are approximately
$5,000.00 for Consulting Services, bringing the total funds required
to an amount of $72,713.82. The budget allocation for this project is
$68,500.00 as reflected on page 195 of the Capital Budget. It is
therefore proposed that the additional funds required in the amount of
$4,213.82 ($67,713.82 contract price plus $5,000.00 consulting less
$68,500.00 budget allocation = $4,213.82) be drawn from the Community
Services Lot Levy Account #1110-156-X.
The Treasurer has reviewed the funding requirements and concurs with
the recommendation. Queries with respect to department needs, specif-
ications, etc., should be referred to the Director of Community
Services.
After further review and analysis of the bids by Purchasing, Daniel J.
O'Brien and Associates Ltd. and Community Services, it was mutually
agreed that Oshawa Garden Service Ltd., Oshawa, Ontario, be
recommended for the contract for Westview Park Development.

Schedule "A".

The subject firm have previously performed satisfactorily for the Town
of Newcastle.

Wa have reviewed the tenders as submitted and recommend
that the responsible bid by Oshawa Garden Service be accepted
as adjusted. We are personally familiar with Oshawa Garden
S0rvice's past construction experience and recommend that
this firm be awarded the Westview Park landscape construction
tender.
