REPORT #: FD 6-90 FILL= #: 10.12.6 $UB,ECT: BURNING BY-LAW RECOMMENDATIONS: It is respectfully recommended: 1.) THAT Report FD6-90 be received; 2.) THAT the By-law attached to FD6-90 be forwarded to Council for passage; and 3.) THAT By-Law 75-33 and all amendments be repealed. 1. 1.1 In 1975 the Town of Newcastle passed a By-law to regulate the setting of fires within the Town of Newcastle. 1.2 This By-law restricts all open fires in accordance with subsection 2.6.3.4 of the Ontario Fire Code. The regu- lation in the Fire Code prohibits all open air burning without approval, unless such burning consists of a small, confined fire, supervised at all times, and used for cooking food on a grill or a barbecue. 1.3 The aforementioned approval shall be in the form of a written burning permit issued by the Fire Chief. 1.4 In 1975 the By-law was amended by By-law 75-84 and allowed for the burning of leaves in Wards 1 & 3 be- tween the months of September and November. REVIEW AND COMMENTS 2.1 It has been realized, in the past few years, that the amendment to allow the burning of leaves has caused a number of concerns. 2.2 The first is that of an environmental nature, given the concerns expressed over any unnecessary open burning. 2.3 The second and most often realized concern is that of neighbourhood disputes caused by the burning of leaves and generating of substantial amounts of smoke. 2.4 This Department responds, on a regular basis, to burning complaints which are caused by the burning of leaves in urban areas. It is safe to state that, during .the time presently identified for the burning of leaves, the fire department responds several times weekly to this type of call. This seems to be an unnecessary expense that could be reduced should the existing by-law be revised. 2.5 Given the emphasis being placed on composting and the programs in place for the pick up of leaves, it would seem that the need for this type of burning is no longer required. With the number of complaints being received, it would seem that it is not a desirable practice with most residents. 2.6 Based on the above comments, it is respectfully recommended that the action outlined herein be approved and that the new by-law be passed.
