Council Minutes PUBLIC MEETING PRESENTATIONS - 2 - November 26,2001 A public meeting is being held for the purpose of: . Passing a by-law to stop, close and convey the south half of the unopened road allowance between Lots 18 and 19, Concession 7, former Township of Clarke, now in the Municipality of Clarington No one spoke in opposition to or in support of this road closure. Rick Paterson and the Bowmanville Legion Pipes and Drum Band performed three songs for the Mayor and Members of Council. The Mayor presented Mr. Paterson with a plaque in recognition of their 50th anniversary and in recognition of their accomplishments. The Band competed in Grade 4 and has placed: 15t at Fort Erie, Montreal and Fergus 2nd at Georgetown 3rd at Barrie Bowmanville is the Canadian Champions in Grade 4 for this year. Council Minutes PRESENTATIONS ANNOUNCEMENT - 3 - November 26, 2001 Rudy Vandersluis, Director of Emergency Services and Keith Kirkpatrick, Fire Services & PAD Coordinator, Lakeridge Health Oshawa, 1 Hospital Court, Oshawa, L 1G 2B9, provided Council with a slide presentation regarding an Advanced Life Support Program for Durham Region. Every year 60,000 Canadians die from sudden cardiac arrests. This means 5 people per 10,000 of population in our community will die from a cardiac arrest in the next 12 months. Mr. Vandersluis explained how serious sudden cardiac arrest is and the automated external defibrillation chain of survival as follows: . Early access . Early CPR . Early defibrillation . Early ACLS They are encouraging the development of a public access defibrillation program and discussed the legallsafety issues regarding defibrillation. Mr. Kirkpatrick explained that a Municipal Program Leader and the Durham Region Base Hospital would be responsible to manage the program. The present goal is to coordinate an effective and unified PAD program and to gain lower and upper tier political endorsement. The Clerk advised prior to the meeting that the presentation of Rick Pigeon, Chief Building Official, has been rescheduled to December 3, 2001. Earlier in the evening, Councillor Trim and Divisional Fire Chief Gord Weir presented Norm Tillson with an exemplary service medal for his 20 years of service with the Emergency Services Department. Council Minutes . DELEGATIONS . . . . . . . . . . . . -4- November 26,2001 Terry Hutchinson, Chair, Samuel Wilmot Nature Area Management Committee, R.R. #5, Bowmanville, L 1 C 3K6, appeared before Council to present the Samuel Wilmot Nature Area Management Committee's Annual Report. Mr. Hutchinson recognized other Members of the Committee, acknowledged staff and Members of Council for their help and support over the years. The plan for this area was put in place a couple of years ago to create a nature area, not a park, ball diamond or soccer fields but someplace people could walk their dogs, listen to the birds and watch the fish. The Committee has been meeting monthly since appointed. The projects that have been completed are as follows: . Selected sub-committees; Developed a sign for the west parking lot; Developed plans for Westside Trail, the trail is partially constructed; A member developed a plan of action for fund raising; Developed garbage collection to overcome garbage problem; During Earth Week they had a series of hikes; Prominent at the Maple and Apple Festivals; Serious problems with A TVs and motor vehicles, this problem is being handled through the Planning Services and Engineering Departments; and TODS signs (directional signs) have been posted. . . . . . . . . Ongoing Projects: Cooperation with MNR and Conservation Authorities regarding restoration of Wilmot Creek; Developing new brochures; Access the plans; Tree planting; Work on newsletter; Westside Trail and lookout to be completed; Establishing fishing trails along the creek; Allow sensitive areas to regenerate; Use volunteers and provide workshops for them; and Providing environmental housing for bats, blue birds, etc. . . . Council Minutes DELEGATIONS - 5 - November 26, 2001 Mr. Hutchinson urged Council to introduce a policy on the use of volunteers. Ken Bray, a Member of the Committee, has produced a video of the area that can be obtained from the Planning Services Department. Mr. Hutchinson thanked the Mayor and Members of Council for the opportunity to sit on the Samuel Wilmot Nature Area Committee and advised that he and his wife will be moving out of the municipality this year. Evelyn Stroud, 89 Little Avenue, Bowmanville, L 1C 1J9, appeared before Council regarding safety in public locations. Ms. Stroud referred to a newspaper article quoting the World Health Organization's Kobe Centre for Health Development stating that Mayor Hazel McCallion showed a great deal of insight in realizing that urban violence is a health issue and a planning issue. It has always troubled Ms. Stroud when she drives along regional roads and sees blocks and blocks of high wooden privacy fences with no access to the houses. She understands that in the interest of traffic circulation and safety, they limit access to regional roads. The people whose backyards face onto the regional road don't want to see or hear all the traffic; so she presumes that the developers are required to build the privacy fences at the back of the yards. However, this has created a major safety hazard. Anyone in trouble would have to run blocks to find safety. The people living in the houses couldn't see or hear them. When you drive north on Mearns Avenue from Highway 2 to Concession Street, there is the beginning of a situation where people in danger would be isolated from safety. There are several blocks of high privacy fences. Ms. Stroud is requesting Council to ask the Planning Services Department to study this issue and bring back a report finding another solution that would grant residents some privacy without denying the rest of the community their safety. "CARRIED" Minutes of the Animal Advisory Committee dated October 10, 2001. (Received for Information) Larry O'Connor, Chair, Durham Advisory Committee on Homelessness, Region of Durham, providing Council with a copy of the Community Plan for Homelessness in Durham. This plan has been developed in consultation with individuals, community organizations, government agencies, as well as elected officials. The Plan provides a comprehensive review of the issues related to homelessness across Durham Region and documents the availability of programs and services to people who are homeless or at risk of becoming homeless. Council Minutes - 7- November 26, 2001 . COMMUNICATIONS It identifies gaps in existing services, areas that need to be enhanced in order to reduce homelessness in Durham, as well as the need for a consistent approach for groups wanting to access funding for homelessness initiatives. (Received for Information) 1-5 A12.TE Joanne Jackson, Station Manager, Rogers Television, Durham, reminding Council of the contributions made by Rogers Television to the community. Council may have been contacted recently by several broadcasting groups asking for endorsement of their application for a new commercial television station for the 905 belt. Rogers Television in Durham is proud of its commitment to local programming. Last year, our local Rogers Television station produced over 700 hours of original, local programming. The Durham station also contributed to the GT A total of 280 hours of original, local programming per week. This included gavel-to-gavel coverage of municipal council and regional council meetings. Their daily local news program recently rebranded as First Local News is dedicated to the issues and stories of this region only. Just this past month of October they produced 216 local news and information stories in the Durham community. At Rogers Television, they are part of the community. The staff and volunteers are involved with schools, community groups and local charities. They understand there may be a desire to get a new commercial television station in this market, but they hope it won't come at their expense. . (Received for Information) 1-6 A01.FE Federation of Canadian Municipalities, advising Council that the National Guide to Sustainable Municipal Infrastructure: Innovations and Best Practices is a project funded under the Infrastructure Canada Program and implemented by a partnership of the Federation of Canadian Municipalities (FCM) and the National Research Council (NRC) and a community of participants and professional associations. The aim of the Guide is to assist municipalities with decisions regarding the long term planning and prioritizing of funding allocations for municipal infrastructure, and in the selection of the best technical solutions to the infrastructure challenges which municipalities face. Sixteen subjects have been chosen as the first priorities for the Scans. The Scans have been awarded to consulting firms that will be gathering information regarding the present use of best practices in municipal government. . (Received for Information) . . . Council Minutes COMMUNICATIONS 1-7 E06.GE 1-8 C06.CL 1-9 M02.GE 1-10 L 11.GE I - 11 F24.GE - 8 - November 26,2001 Anne Powell, Director - Distribution Regulation, Regulatory Affairs, Hydro One Networks Inc., providing Council with a copy of Hydro One Networks' submissions to the Board on retail transmission service rates, wholesale market service rates and standard supply service rates as filed with the Board on November 5, 2001. These proposed rates will only come into effect when the electricity market is opened to competition. The proposed rates recover costs incurred by Networks to bring the electricity commodity to its distribution system. (Received for Information) Minutes of the Clarington Agricultural Advisory Committee meeting dated October 11, 2001. (Received for Information) Michael Hackenberger, Director, Bowmanville Zoo, thanking Council for their gesture of sympathy after Bongo's death. He can't believe the outpouring of sympathy they have received from friends and associates within the community. It stands as proof of how special a lion Bongo was to everyone who knew him, not just his closest friends and family at the zoo. On a more positive note, they are thrilled to announce that Bongo's companion, Gracie, the lioness is pregnant. The birth date has been established as some time at the beginning of December. (Received for Information) Ministry of Citizenship, providing Council with a copy of the proposed Ontarians with Disabilities Act. The ground-breaking legislation being proposed is aimed at increasing accessibility, opportunity and independence for Ontarians with disabilities, and puts persons with disabilities at the forefront of change for the first time. (Received for Information) James M. Flaherty, Minister of Finance and Chris Hodgson, Minister of Municipal Affairs and Housing, announcing that for 2002 the Community Reinvestment Fund (CRF) will continue to be linked to the Local Service Realignment (LSR). A year-end reconciliation for 2001 will be done in October 2002. Specific details on the calculations of the 2002 CRF allocation will follow. . . . Council Minutes COMMUNICATIONS 1-12 C10.MO 1- 16 M02.GE - 9- November 26,2001 They are also pleased to announce that, in light of the recent Provincial announcement on municipal transit funding and its impact on the CRF formula, the Province is establishing the new "Transit Bonus" in addition to the CRF Base, CRF Bonus and Supplementary Assistance. Madill, Regional Clerk, Region of Durham, advising Council that the Region of Durham on November 14, 2001, passed the following resolution: "a) THAT the proposed Community Safety Zone Warrant be approved; b) THAT Community Safety Zones be installed only at specific sites where significant improvements to traffic safety can be realized, and where the Durham Regional Police Service can provide consistent levels of enforcement to ensure the effectiveness and continuance of the program; c) THAT the Ontario Traffic Conference and the Province be requested to review the design of the existing Community Safety Zone signs and the judicial application of the legislated fine structure; and d) THAT a copy of Report #2001-W-132 of the Commissioner of Works be forwarded to the Area Municipalities, the Durham Regional Police Service and the Ontario Traffic Conference." It is their desire to help those in need, by supplying a traditional Christmas dinner and gifts, for children 16 and under. Council Minutes COMMUNICATIONS 1-3 Agricultural Advisory Committee C10.MO 1-4 Private Sewage Disposal Systems C10.MO - 10- November 26, 2001 Nestor Chornobay, Director, Strategic Planning Branch, Region of Durham, advising that the Region of Durham on October 30, 2001, passed the following resolution regarding the Durham Agricultural Advisory Committee: "a) THAT Commissioner's Report No. 2001-P-91 be received for information; and b) THAT a copy of Commissioner's Report No. 2001-P- 91 be forwarded to the local municipalities and the Durham Region Federation of Agriculture." Council Minutes COMMUNICATIONS 1-14 Property Assessment Clarington Older Adult F22.TA I - 15 Oak Ridges Moraine D02.0A - 12- November 26, 2001 Viola Ashton, President, The Clarington Older Adult Association, thanking Council and Nancy Taylor, Director of Finance for the assistance provided in resolving the property assessment issue. The Association would not been able to provide the service it does if this assessment issue had become a reality. "CARRIED" Co-chairs of the Protect The Ridges writing to Peter Balaban, District Manager, York-Durham District Office, Ontario Ministry of the Environment, advising that they have concerns and requesting information regarding the groundwater testing and bioaerosol study. Protect the Ridges are requesting that the Ministry provide the community with conclusive proof that the Clarington Pit, Sound- sorb berm or 'composting' facility present no threat to the local environment and water wells that they rely on. "CARRIED" Council Minutes - 13 - November 26, 2001 . COMMUNICATIONS D -1 T03.GO Eldred R. King, Chairman, GO Transit, requesting Council to place GO Transit on an exemption list regarding development charges or providing financial securities. At present, when GO initiates an infrastructure project, they submit the appropriate drawings and information for site plan approval, and obtain an appropriate building permit. They comply with municipal requests to dedicate land for road widening purposes, in accordance with Section 41 of the Planning Act. As they are currently subject to Section 41, they will continue to transfer land at no cost until GO Transit reverts back to the Province. GO has recently had to consider municipal requests to pay development charges or provide financial security such as letters of credit for their station projects in several municipalities. They have protested these requests, as, in their view, construction at GO stations is exactly the type of infrastructure for which development charges are imposed in the first place. In addition, they do not think it is appropriate for one public agency to require another public agency to provide financial security such as letters of credit. D-2 M02.GE Bruce Gilbert, Coordinator, requesting permission to use the Andrew Street Parkette from 3:00 p.m. to 10:00 p.m. for the 3rd annual Newcastle Family Celebration on Sunday, December 30, 2001. As in previous years, this celebration will be a community event during which time families of their neighbourhood can join together for a variety of fun, food and a pyrotechnic show that will be put on by a licensed pyrotechnics specialist. Literacy Network of Durham Region is committed to providing support and direction to literacy activities in the Durham Region. On October 6, 2000, they launched the Family Literacy Kit which they designed to promote family literacy and learning for life. . (Proclaimed) . . . Council Minutes COMMUNICATIONS D-3 L 11.GE D-5 E05.VE D - 6 C10.MO - 14 - November 26, 2001 Ministry of Municipal Affairs and Housing, inviting Council to comment on the new Smart Growth management councils that will guide the way our province grows. The province is asking the public and stakeholders to offer their ideas on the mandate of these councils, who should sit on them and the boundaries of the zones they would cover. The primary functions of the management councils would be to develop Smart Growth management plans which provide a long-term vision for economic growth along with strategies to improve the quality of life and protect the environment in each zone. "CARRIED" David Clark, Executive Vice President, Corporate Affairs, Veridian Corporation, requesting Council to execute an inter-creditor agreement between the Bank of Nova Scotia, the Town of Ajax, the City of Belleville, the Municipality of Clarington, the City of Pickering, Veridian Corporation and Veridian Connections Inc. confirming the subordinated ranking of municipally held promissory notes to the senior debt financing to be issued by Veridian Corporation. Resolution #C-644-01 Moved by Councillor Pingle, seconded by Councillor Robinson THAT Correspondence Item D - 5 be approved and the Mayor and Municipal Clerk be authorized to execute the agreement. "CARRIED" Dianne Hill, CAOIClerk, the Township of Havelock-Belmont- Methuen, advising Council that the Township of Havelock-Belmont- Methuen on November 6, 2001, passed the following resolution: "WHEREAS every resident of the Province of Ontario is entitled to standardized health services; . . . Council Minutes COMMUNICATIONS - 15 - November 26, 2001 AND WHEREAS the Province of Ontario sets the regulations for these services; AND WHEREAS the Province of Ontario has downloaded the ambulance service to the County; AND WHEREAS each County has determined how this service will be provided, be it a County Service, or privatized; AND WHEREAS this defeats the intention of a standardized ambulance service; AND WHEREAS the Province of Ontario has withdrawn large sums of funding through Community Access Centres, which provided home care services; AND WHEREAS the intent was to relieve the large cost of emergency rooms, ambulance and fire, by providing the home care services; AND WHEREAS, it has come to the point of the ability of each municipality to be able to pay for various health services; AND WHEREAS each municipality, depending on their ability to pay, will receive a different level of service; NOW THEREFORE BE IT RESOLVED, that the Council of the Township of Havelock-Belmont-Methuen, hereby requests, every municipality in the Province of Ontario to petition their Members of Provincial Parliament and their Federal Member of parliament to return our former health system, within the Province of Ontario; AND THAT they assume full financial responsibility for a standardized health system." . . . Council Minutes COMMUNICATIONS D-7 T07.GE - 16- November 26, 2001 Resolution #C-645-01 Moved by Councillor Schell, seconded by Councillor Trim THAT the resolution from the Township of Havelock-Belmont- Methuen regarding standardized health services be endorsed by the Council of the Municipality of Clarington. "CARRIED" Brad Savage, Resource Development Co-ordinator, Junior Achievement Durham Region, requesting Council to consider them for inclusion on the Service ClubslCommunity Groups signs at the entrance to urban areas within Clarington. Junior Achievement serves all of Durham Region and is represented on a continuing basis in Clarington's public and separate schools. In addition, they are grateful for the volunteer and investor support generated by members of this municipality. Each year, Junior Achievement of Durham Region programs in school such as Business Basics, which provides Grade 5 and 6 pupils with information on organization and operation of business; and the Economics of Staying In School for Grade 8 children, a comprehensive program that influences those at risk of leaving school prematurely and reinforces those who intend to graduate. Their organization is non- profit and while they are not a service club, they are a community- based service with a volunteer board of directors drawn from local sources. "CARRIED" . . . Council Minutes COMMUNICATIONS D-8 F11.GE D-9 F11.GE - 17- November 26, 2001 Elisha MacMillan, requesting financial support for the chance to help children in Thailand learn English. Ms. MacMillian is a resident of Bowmanville and is currently attending Bowmanville High School at the OAC level. She has been planning an exchange to Thailand, through the school co-op, for ten months now, where she will teach English for half of next semester and work in an orphanage or hospital for the second half. The total cost of the exchange is $6500.00. She has already paid $2000.00 that she saved from working at her part-time job at McDonalds and had an agreement from an individual that they would sponsor her an additional $2500.00. This sponsorship fell through and she now owes $2500.00 as of December 1 or her trip will be cancelled. Ms. MacMillian has turned to many businesses and they have all declined. "CARRIED" John Thomson, Chair, Orono Crown Lands Trust, requesting funding from the municipality for some of their start-up and property improvement costs regarding the Orono Crown Lands. The Orono Crown Lands Trust has successfully negotiated a partnership agreement with the Ministry of Natural Resources to provide ongoing stewardship for the approximately 1100 acre Orono Crown Lands. They have recently completed their first major maintenance project which included the re-cutting of the fire breaks and the opening of the major vehicle roads through-out the property. Some future near term projects include erecting a gate at the west end of the bridge over Wilmot Creek, to limit unauthorized vehicle access to the property. They also plan re-vegetation of the area surrounding the Second Flume. The Orono Crown Lands Trust is a volunteer organization formed to provide and supervise the day-to- day operation, management and maintenance of this valuable natural resource. . . . "CARRIED" D - 10 F11.GE Dave Climenhage, Chairman, Great Canadian Town Band Festival, requesting an extension to the repayment of the balance of the interest free loan in the amount of $12,000 to December 31,2002. "CARRIED" Councillor Trim gave a verbal report regarding public transit. On November 13, 2001, he attended the Canadian Urban Transit Conference. It was a one day program comprised of two parts. The first part was an exhibit of buses consisting of panel trucks to highway coaches and a double-decker bus from the City of Brampton. The second part consisted of a key speaker, Ian Brown from London, England who is responsible for all transportation services including underground services. In Canada, the average age of an urban public transit vehicle is 14 years. Public transit is a long-term commitment, complex and costly. We must thoroughly investigate public transit before making a decision. Councillor Schell attended a presentation at the Region of Durham from the Toronto Airport Authority regarding the Pickering Airport lands. A house in Brougham has been established as a site office for information. Councillor Schell will be attending the Central Lake Ontario Conservation Authority Watershed Awards on December 11, 2001, at Camp Samac in Oshawa. Councillor Trim advised Council that the Director of Senior Complexes, Sharon Swain, is retiring on November 30, 2001. He advised Council that he is still awaiting the results of the sludge testing from the Ministry of the Environment. Councillor Trim also advised Council that he attended a seminar by Dr. Donna Reynolds reported on the West Nile Virus. . Council Minutes OTHER BUSINESS Boards and Committees Update . . - 24- November 26, 2001 Mayor Mutton advised that the Region is in the process of setting targets for taxes. He advised that the Region will need to take a look at downloaded services and phasing out frill services. Transferring debt cost of 4% is unacceptable. Councillor MacArthur reported that he was very pleased with the efforts of Marie Marano, Joe Caruana and Sheila Schweizer with the current situation of staffing at the Bowmanville Museum Board. He also reported that the Library Board has a search committee looking for a replacement for Ms. Cynthia Mearns, Chief Librarian. Councillor MacArthur represented the Mayor at an announcement from Tony Clement at the Bowmanville Hospital regarding the Province paying for on-call funding, which has been agreed upon months ago. Councillor Robinson advised Council that on November 30, 2001, Orono and Newcastle will be holding their Tree Lighting Ceremonies. Kendal will be holding their Tree Lighting Ceremony on December 1, 2001. Councillor Robinson would like to commended the efforts of Joe Caruana regarding the joint meeting of the Museums and the Visual Art Centre. Councillor Rowe advised Council that the 3rd Annual Tree Lighting Ceremony in Courtice will be held on December 5, 2001, at 6:00 p.m. The Courtice Area Ratepayers will be holding a Town Hall meeting with the Kawartha Pine Ridge District School Board on December 5, 2001. On Sunday, November 18, 2001, the Local Architectural Conservation Advisory Committee hosted the Durham Regional Local Architectural Conservation Advisory Committee meeting. They put on a great effort but the meeting was not well attended. The guest speakers included Heather Thompson and Bill Humber. Councillor Rowe advised that there are two new picture walls located outside the Council Chambers. The Clarington Youth Advisory Committee is holding an art contest on November 29, 2001. Councillor Schell advised Council that the Bowmanville BIA will be holding their Tree Lighting Ceremony on December 7,2001, which will also kick off the Midnight Madness Event. The event is always well attended. The Hampton Tree Lighting Ceremony will be held on December 11, 2001, at 6:30 p.m. at the community centre. Mayor Mutton, Frank Wu, Chief Administrative Officer and Dennis Hefferon, Solicitor attended the meeting in Ottawa regarding Bill C27 - Waste Management Organization. They discussed on-site storage, below and above ground storage. The Mayor put forward amendments which were moved by Gerald Keddy, MP, Nova Scotia, but was very disappointed that all amendments were defeated. Mayor Mutton advised that Iter delegation was here three weeks ago. The Japanese, Russian and Europeon union had a tour visiting schools and GM headquarters. They recognized that Clarington has the best site in the world and it was the first time they have recognized that Canada and Clarington have set the standard for community support. Tony Cannella, Acting Director of Engineering gave a verbal report regarding an incident that occurred last week regarding trees that were cut down in North Bowmanville. The event caused the Municipal Law Enforcement Division to attend the site for violating the Tree Cutting By-law and the Tree Conservation and Preservation Plans. Staff stopped the developer of the subdivision immediately. The developer will be responsible for tree compensation and rough grading of the site will not continue until funds are provided. Letters of Credit will be posted in the amount of $40,000, $10,000 for tree replacement and $30,000 for grading. . . .
