HomeMy WebLinkAbout2011-037BY-LAW 2011-037 Being a by-law to amend By-law 2011-016, a by-law to govern the proceedings of the Council of the Municipality of Clarington, its General Purpose and Administration Committee and Special Committees WHEREAS at its meeting held on March 28, 2011., Council passed Resolution No. C-168-11, to amend the procedural by-law to delete references to 'Notices of Motion" THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: THAT By-law 2011-016 be amended as follows: a) Subsection 1.2 be amended as follows: by deleting the reference to "Notice of Motion"; and ii) inserting a new reference which reads: "Procedural Notice of Motion means a written notice, including the names and signatures of the mover and seconder, advising Council that the motion described therein to amend something previously adopted by Council, to rescind a previous decision of Council, to lift a matter from the table, or to reconsider a previous decisioh of Council, will be brought forward at a subsequent meeting." b) Subsection 6.1.1 be amended by deleting the liries that read "Business Arising from Notice of Motion" and "Notices of Motion (for consideration at subsequent Meeting)" and replacing them with "Business Arising from Procedural Notice of Motion (to be included on agenda only if there is business to be considered under this section) and "Procedural Notices of Motion (for consideration at subsequent Meeting); c) Subsection 7.9 be amended by adding the word "Procedural" before the word "Notice(s)"; d) Subsection 7.9.1 be amended by adding the word "Procedural" before the word "Notice' in the first line, by deleting the words "in accordance with- subsection 7.12" and by deleting the words "subject to subsections 7.12.2 and 7.12.3."; e) Subsections 7.12 be amended by adding the word "Procedural" before the word "Notice(s)' f) Subsection 7.12.1 be deleted and replaced with the following: "Procedural Notices of Motions introducing a motion to amend something previously adopted by Council, to rescind a previous decision of Council, to lift a matter from the table, or to reconsider a previous decision of Council as described in subsections 10.12.8, .10.12.9,10.12.26 and 10.12.30, respectively, shall be given to the Municipal Clerk, in writing and signed. by the mover and seconder at a meeting of Council, but shall not be debated until the next regular meeting of Council." g) Subsection 17.12.2 be amended by adding the word "Procedural" before the words "Notice' in the first, second and third .lines. h) Subsection 17.12.3 be amended by adding the word "Procedural" prior to the word "Notice"; Subsection 7.12.4 be amended by deleting the words "Notwithstanding anything contained in this subsection. 7.12", by inserting the word "only" after "may", by deleting the words "without notice", and by renumbering the subsection as 7.13.2; - z - j) Subsection 7.12.5 be.deleted in its entirety; k) Subsection 10.12.15 be deleted and .replaced with the following: "A motion to amend a previous action of Council requires a majority vote of the Members present and voting provided that notice has been given in accordance with subsection 7.12, and in case the aforesaid notice has not been given, the motion to amend a previous action of Council requires atwo-thirds (2/3) vote of the Members present and voting." I) .Subsection 10.12.28 be deleted and replaced with the following: "A motion to rescind a previous action of Council requires a majority vote of the Members present and voting provided that notice has been given in accordance with subsection 7.12, and in case the aforesaid notice has not been given, the motion to rescind a previous action of Council requires atwo-thirds (2/3) vote of the Members present and voting." m) Subsection 10.12.30 a) be amended by inserting the word "Procedural" prior to the words "Notice" ih the first and second line and deleting the words "has been given by a Member;". 2. THAT this By-law shall come into full force and effect upon its passage. Passed in open sessiori this 28th day of March 2011. Municipal Clerk
