Ontario Regulation made under the Planning Act.

Superbuild Infrastructure

(the"Municipality")has received and considered the Government of Ontario
SuperBuild Corporation Sports,Culture and Tourism Partnerships("SCTP") i
initiative Round 1 Application Guidebook(the"Guidebook");
AND WHEREAS Council has assessed its capital priorities against the SCTP
initiative Round 1 application requirements as set out in the Guidebook and
intends to submit a letter of intent for qualifying the"Municipality's project"
(the"Project")for funding under Round 1 of the SCTP initiative;
AND WHEREAS Council advises that the Region of Durham is responsible for
the Municipality of Clarington's compliance with the new Ministry of
Environment Drinking Water Protection Regulation,Ontario Regulation 459/00

AND WHEREAS Council considers the Project to be its highest sport,

Waterfront Trail

WHEREAS the Council of the Corporation of the Municipality of Clarington
("the Municipality")has received and considered the Government of Ontario
Superbuild Corporation Sports,Culture and Tourism Partnerships initiative
Round I Application Guidebook;
AND WHEREAS the Council has resolved to submit a letter of Intent to the
Ontario Superbuild Corporation respecting qualification for funding of certain
projects under Round I of the SCTP initiative;
AND WHEREAS Council has been an active partner with the Waterfront
Regeneration Trust in achieving the vision of a continuous waterfront trail;
AND WHEREAS Council supports the initiatives of the Waterfront
Regeneration Trust,and has adopted the nine principles for Clarington's
waterfront, which is clean,green,connected,open, accessible, useable,diverse,
affordable and attractive;
AND WHEREAS the Waterfront Regeneration Trust is seeking partners in their
submission to the Ontario Superbuild Fund for projects along the Waterfront
Greenway; !_
AND WHEREAS Council has undertaken several land acquisition initiatives
and developed concept plans for waterfront lands and linking valleylands;

1.3 Rezoning: From: "Urban Residential Exception (R1-12)"
To: An appropriate zone to permit the expansion of the existing
funeral home, on the adjacent subject property, with an
associated parking lot
2. LOCATION
i
2.1 The subject lands are located in Part Lot 11, Concession 1, former Town of Bowmanville.
The lands are further described as being located at 70 Wellington Street, immediately
abutting Northcutt Elliot'Funeral Home and one lot east of Division Street on the north
side of Wellington Street.
3. BACKGROUND
3.1 The applicant has submitted an application to rezone the property at 70 Wellington Street.
The rezoning application and related site plan application, if approved, would allow a
135.2 m2 expansion to the existing funeral home. The majority of the expansion would be
contained on the existing funeral home property at 53 Division Street, with approximately
1.6 m of the proposed 8.0 m wide addition actually located on the lot subject to rezoning.
The balance of the lot would be used to accommodate parking for the addition and the
existing funeral home. The existing single detached dwelling at 70 Wellington Street is
proposed to be demolished to accommodate the proposed expansion and additional U
parking.
3.2 In 1990 a rezoning application was filed for the lands behind the subject property to permit
a parking lot for the existing funeral home. At that time 17 off-street parking spaces were
created, where previously there was none. During a recent site inspection of the property,
it is noted that the driveway for the existing dwelling has been extended along the east
property line to provide a secondary access to the 17 off-street parking spaces. In addition,
I
a walkway has been constructed along the west boundary of the subject property for
pedestrian access from the side walk to the parking area.
3.3 The Public Meeting for the rezoning application was held January 8, 2001. A
neighbouring land owner addressed the Committee enquiring about the location of the

driveway for the future parking lot and the impact it would have on his driveway across the
street. The east limits of the neighbouring property across the street are just about in line
with the east limits of the subject property. The driveway on that lot is located abutting the
east side lot line. The proposed driveway, for the funeral home expansion, will be centred
on the subject property and will be a one-way only,providing access into the parking lot.
The existing access to the parking will provide the egress. Based on this configuration
staff do not foresee any conflict.

4. EXISTING AND SURROUNDING USES

4.1 Existing Uses: single detached dwelling
4.2 Surrounding Uses:
North: Parking area for existing Northcutt Elliot Funeral Home
South: Wellington Street and single detached dwellings
East: Single detached dwellings
West: Northcutt Elliot Funeral Home
5. OFFICIAL PLAN POLICIES
5.1 Durham Region Official Plan designates the subject lands Living Area. The predominant
use of land within the Living Area ea designation shall be for housing purposes. Section
10.3.1 (b) states that limited office development and limited retailing of goods and
services, in appropriate locations provided that the functions and characteristics of
designated Central Areas are not affected, is permitted.
5.2 The Clarington Official Plan designates the subject lands as Urban Residential. The
predominant use of land within the Urban Residential designation shall be for housing C
purposes. "Other uses may be permitted which by their activity, scale and design are
supportive of, compatible with and serve residential uses." These include among other
uses community facilities in accordance with Section 18 of the Plan. The application is
considered to be in conformity.

6. ZONING BY-LAW PROVISIONS
i
6.1 The subject lands are zoned"Urban Residential Exception(R1-12)". A funeral home is
not permitted in this zone,hence the application for rezoning.

7. AGENCY COMMENTS
7.1 In accordance with departmental procedures, the application was circulated to obtain
comments from other departments and agencies. The Clarington Fire Department, offered j
no objection or concerns with the application as filed.
7.2 The Clarin on Public Works Department� p ent offered the following comments:
i) Engineering Division:
i
No objection to the rezoning application. The site plan application is subject to the
following conditions. The applicant's engineer will be required to prepare Grading and j
Drainage Plan that details the configuration of the on-site storm sewer(minor system) and
conveyance of the overland flow(Major system) from this site and the applicant will be
required to make application for property access and shall be responsible for the cost of
cutting the curb at the new entrance.
ii) Parks Division: L
The applicant will be required to provide and appropriate cash contribution in lieu of
parkland dedication as a condition of approval.
iii) Building Division:
The applicant has been made aware of the information required for building permit relative
to occupant loads and revisions to entrances.
7.3 Veridian Connections advised that electric service is available from the road allowance
touching this property. The Corporation provided a list of requirements related to the site
plan, which have been forwarded to the applicant's agent.

7.4 Regional Planning Departnment staff advised that the subject property is designated"Living
Area" in the Durham Regional Official Plan. Lands within this designation shall be
predominantly used for housing purposes. However, limited retailing f

funeral home would also be permitted within the context of Policy 10.3.1 b) of the Durham
Regional Official Plan. The subject rezoning application conforms. In addition, no
provincial interests were identified for this application when screened in terms of
the
provincial plan review responsibilities.
7.5 Regional Works Department staff advised that municipal water and sanitary services are
available to the site. The Region will disconnect any abandoned services at the expense of
the owner. The applicant will need to contact the Region of Durham Works Department
for this work prior to issuance of a building permit.
7.6 Central Lake Ontario Conservation Authority advised they have no objection to the
rezoning application to permit the expansion of the existing funeral home. They also
expressed no objection to the site plan in principle,however requested detailed
q grading,
drainage and sedimentation control plans prior to finalizing the site plan.
8. STAFF COMMENTS
8.1 The applicant is proposing a 135 m2 addition to the existing funeral home located at the
corner of Wellington and Division Streets. The majority of the building addition is
HA; proposed to be accommodated on the lands presently zoned to permit a funeral home.
However, a small portion of the building and all the required parking for the addition are
proposed to be accommodated on the adjacent, subject property to the east.
8.2 The subject property currently contains a single detached dwelling which the applicant

intends to remove to accommodate the expansion and required parking. The 135 m2
addition requires 15 parking spaces. The site plan submitted, in conjunction with the
rezoning application, indicates a total of 19 additional parking spaces are being proposed.
In addition, the existing wooden fence along the east property line is to be retained along
with a 1.5 in wide planting strip along the east property line.
8.3 The proposed addition will accommodate additional sitting and visitation room for the
existing Funeral home chapel. This will allow visitors for larger funeral'.to be

accommodated more comfortably, minimizing the number of people who are required to
stand or line up outside. In response to questions raised at GPAC the applicant has
confirmed that there would ml-ver be two funerals at the same time, although there may be
two funerals on the same day.
9. CONCLUSION
9.1 In consideration of the comments received from the various agencies, staff recommends --
approving the proposed rezoning application to allow the proposed 135 m2 floor area and L
associated parking expansion to the existing funeral home. Staff will continue to work

with the applicants and their agent to complete the site plan.

WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to

the expansion of an existing funeral home and associated parking lot.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality
of Clarington enacts as follows:

1. Schedule"3"to By-law 84-63 as amended,is hereby further amended by changing the zone
designation from"Urban Residential Exception(R1-12)" to "Urban Residential Exception EJ
(R1-27)"as shown on the attached Schedule"A"hereto:

3. This By-law shall come into effect on the date of the passing hereof, subiect to the

1.1 The Planning Department has received a copy of four requests submitted to the Local
Architectural Conservation Advisory Committee (LACAC) to designate as having
historic and/or architectural value or interest the properties known as 5277 Main Street,
Orono; 5161 Main Street, Orono; 3335 Lambs Road, Part Lot 6, Concession 3, former
Township of Darlington and 4525 Concession Road 5, Part Lot 8, Concession 4, former
Township of Clarke. The structures are described in Attachments 1 through 4.

1.2 The Ontario Heritage Act empowers a municipality to pass a by-law designating a
structure to be of historic and/or architectural value or interest. The Act stipulates that the
owner of a structure so designated cannot alter the structure where such alteration is
likely to affect the reasons for designation without the written consent of Council.
Council is required to consider any application for alteration of a designated property in
consultation with the LACAC.
2. COMMENTS
2.1 Staff have reviewed the properties in terms of their Official Plan and Zoning By-law
designation and support the designation of the structures, pursuant to the Ontario Heritage 4
Act, as having historic and/or architectural significance.
2.2 It is, therefore, recommended that the Clerk prepare, send and publish the required
Notices of Intent pursuant to Section 29 of the Ontario Heritage Act and report back to
Council following the prescribed notification period.

This c 1916 home has been constructed with a combination of architectural elements. The gable
roof and front porch roof, both with return eaves, are representative of the Classic Revival
period, while the round arch window in the gable, basket arched windows or the first and second L
stories, and the wide eaves are common to the Italianate period. Built in the stretch bond pattern
of brick work, this early 1900s home is recommended for designation under the Ontario Heritage

5161 Main Street, Orono
I
This two storey structure was built in 1899 by Thomas Doncaster and his son, Edgerton.
Edwardian in style, it contains a front facing balcony and rear facing dormer. Italianate features
are also evident in its paired and carved eave brackets, double front entrance door, and round top
first floor window. The first occupants of the home were George Harris Linton and his wife,
Alfretta, and upon its completion the local newspaper deemed it worthy of description. The
longest residents were Almerick and Martha(Trull) Gamsby and family. Almerick was a noted
hunter in the area and his trophies adorned the front porch for many years. It is recommended for
designation under the Ontario Heritage Act for.its historical significance and the following
architectural features:

Part Lot 6, Concession 3, former Township of Darlington
This traditional Ontario farmhouse was constructed in 1890 by the Prout family. The house was
once part of the Model Dairy, run by the Luxton family who were the second owners of the
home. A small milk house still exists on the property with the cooling pits for the milk cans.
The home has a centre gable with a finial, which is common to the farmhouse style. It still
retains its original clapboard siding, two over two sash windows, and interior woodwork. It is
recommended for designation under the Ontario Heritage Act for its historical significance and
the following architectural features:

Part Lot 8, Concession 4, former Township of Clarke
This L-shaped Victorian farmhouse typifies the Gothic Revival form of architecture with its
gables, dormer, bargeboards, finials, and elaborately decorated porch and veranda. Built in 1889,
the house still retains its original metal shingled roof. The drive shed, barn and chicken coop are
also well preserved and are assumed to have been constructed during the same period. All four
structures are recommended for designation under Par IV of the Ontario Heritage Act for their
architectural features as follows:

1. BACKGROUND
1.1 On September 13, 2000, a letter was received from Michelle Clarke requesting a Crossing
Guard be placed at Simpson Avenue at Jane Street in Bowmanville. At the present time
her daughter is unable to be bussed as she is within walking distance to Ontario Street
Public School. The only aide that is available to her to cross Simpson Avenue is at
Simpson Avenue and King Street where there is lights and a Crossing Guard available.
.� For her daughter to walk to the lights, cross, then walk back to Jane Street it will add 20
minutes to her trip as well as put her over the kilometers that is considered walking
distance.

1.2 At the Council workshop on Friday, January 5t , 2001, Members of Council identified
i
citizen interest in placing a School Crossing Guard at the intersection of Fourth Street and
Scugog Street in Bowmanville.
1.3 On October 2°d, 2000, Council received a letter from Diane Akermann and Susan Loeb
requesting that a Traffic Study be conducted to determine if a crossing guard would be
necessary at the corner of Worthington Drive and Robert Adams Drive in Courtice. J
They noted that on June 5`h, a letter was sent to their homes by Dr. Emily Stowe Public
School advising that the bussing would no longer be available to students living in the
Robert Adams and Hemingway Drive area. Due to temporary safety concerns as a result
of construction and some streets not being completed in the area, the Board decided to
temporarily provide bus transportation to students. Once the construction had been
completed, the Board advised that transportation would be discontinued at the end of the
school year.

according to Board Policy. As a result, they now have a number of children walking to
and from school from this area. They noted that with Robert Adams Drive becoming "an
increasingly busy" street as the community continues to grow, they are concerned for , r
safety of their children and therefore request consideration be given to providing a
Crossing Guard.
2. MUNICIPAL POLICY
The standard method to determine the need for an Adult Crossing Guard in an unbiased
and consistent method was , :veloped by the Institute of Transportation Engineers and is

used by many municipalities throughout North America. The technique involves the use
of a stop watch to determine the length and quantity of safe gaps between vehicles.

In 1991 the Municipal of Clarington adopted a "50% delay" as the threshold for the
introduction of an Adult School Crossing Guard.
3• REVIEW AND COMMENTS
3.1 Simpson Avenue at Jane Street, Bowmanville
A Traffic Study was conducted by the Traffic Co-ordinator of the Public Works
Department. Upon completion the following was noted:
■ October 2, 2000 pm - 63.8%
■ October 25 _ o
2000 pm 49.4/o
■ January 19, 2001 p.m - 44.2%
School records show that onl y 6 children need to cross this street. On October 25`x,2000
only one child'crossed the street and we must assume the others were driven by parents.
On October 2"d, 2000, 4 children crossed the street but while doing the stud there was a
vehicle working on the corner and it was unclear as to whether the children came from
the west or north. On January 19", 2001, only 2 children crossed at Jane Street while 2
more crossed at Prince Street. It is unusual to see the resulted vary from 63.8% to 44.2%,
however, just prior to the October 2"d, 2000 study there had been some construction
activity on Liberty Street and some traffic may have still been using Simpson Avenue as
a by-pass. Excluding the October 2"d measurement anomaly, he -
, average delay is 46.8%,
below the minimum warrant. Furthermore, there is only a few children potentially
serviced at this location. In the past, Council has turned down a request for an adult
guard in Orono, which had 5-6 children crossing.

3.2 S og Street at Fourth Street, Bowmanville
The existing Crossing Guard located on the south side of Jackman Road assists children
crossing Scugog Street. Observation on the morning of January 22"d, 2001 showed two
young students living between Jackman Road and Sawmill Court who needed to cross =
Scugog Road.

A second Crossing Guard now requested 125 metres to the north to service the new
Sawmill Court. Staff s recommended solution is to provide crossing protection to all the j
children with the relocation of the existing Crossing Guard from Jackman Road to Fourth
Street. This can only be accomplished if a new section of sidewalk is constructed. The
Public Works Department anticipates incorporating into the 2002 Capital Budget
sidewalk installation on the west side of Scugog Street from the north limit of Jackman
Road to 10 metres north of Sawmill Court.
3.3 Robert Adams Drive at Whittaker Avenue Walkway, Courtice
There were two requests for crossings on Robert Adams Drive. The Municipality has -
agreed with the School Board to construct a sidewalk during 2001 to link Whittaker
Avenue to Robert Adams Drive. This is the location where a future Crossing Guard, if
any, should be placed to serve both the north and south residents.

■ January 18, 2001 am - 18.3%
■ January 18, 2001 pm - 32.7%
These numbers fall short of the 50% requirement, however, the Traffic Co-ordinator will
continue to monitor this crossing for any changes in traffic flows. The all-way stop

installed January 12t' , 2001 at Prestonvale Road and Claret Road may cause a slight shift
in traffic over to Robert Adams Drive.
4. CONCLUSIONS
E
4.1 The Traffic Co-ordinator will continue to monitor the Simpson Avenue and Robert
Adams Drive locations. It is recommended that the Crossing Guard for Scugog Street be
relocated at such time as the new sidewalk has been constructed.
4.2 The Director of Public Works have reviewed this report and concur with its contents.

1. BACKGROUND
1.1 The purpose of this report is to provide the General Purpose and Administration
Committee an annual update on information regarding site plan applications that have
been submitted for approval.
1.2 The Site Plan Control By-law requires that plans and drawings for any building or
f ; _
structure be approved by the Municipality prior to issuance of a building permit except
for those exceptions stated in By-law 90-130. By-law 90-130 delegates the approval
authority of site plan applications to both the Director of Planning and Development and
r7 the Director of Public Works.
1.3 Except for additions or minor expansions, a site plan agreement is generally required for
a proposed development to ensure a comprehensive design gn review of the location of all
buildings and structures, landscaping, access permits, parking areas, signage and grading
etc., by all regulatory authorities. In addition, it is through the site plan approval p rocess
that the Municipality collects its cash-in-lieu of parkland dedication, road widening,
performance guarantee etc. Each agreement is registered on title and is enforceable _
against present and future owners.

2.0 BACKGROUND
2.1 The Corporation of the Municipality of Clarington entered into a Subdivision Agreement,
- registered June 29, 1995, with Kalee Investments Limited to develop lands by plan of
subdivision, located in Enniskillen and described as Plan 40M-1826 (Attachment No. 1).

The agreement required the developer to construct all roadworks, including hot-mix paving,
sodded ditches, a storm drainage system and streetlights, hereinafter referred to as the
`Works'.

2.2 The subdivision agreement provides for the separation of the Works into four(4) stages:
(a) Initial Works;
(b) Street Lighting System;
(c) Final Works; and
(d) Stormwater Management System ;
2.3 The Initial Works and Street Lighting System Works were issued `Certificates of
Completion' and subsequent `Certificates of Acceptance' by the Director of Public Works,
as per the maintenance requirements set out in the Subdivision Agreement. -

2.4 There are no Stormwater Management System Works associated with this project.
2.5 The Final Works were issued a `Certificate of Completion'
pletion dated December 1, 1999. This
initiated a one (1) year maintenance period which expired on December 1, 2000. The f
Works have been re-inspected and all deficiencies have now been rectified to the L
satisfaction of the Director of Public Works.
2.6 It is now appropriate to issue a `Certificate of Acceptance' for the Final Works. The
subdivision agreement requires Council approval prior to the issuance of any `Acceptance
Certificate' for Final Works.

2.7 Further to the i--uance of a `Certificate of Acceptance', a by-law is required to permit the

Municipality to assume certain streets within Plan 40M-1826 as public highway

agreement required the developer to construct all roadworks, including hot-mix paving,
sidewalks, curb and gutter, street trees, a storm drainage system and street lights,

hereinafter referred to as the `Works'.
2.2 The preliminary lot grading design for Plan 40M-1977 required a rear yard catchbasin
between Blocks 137 and 138. The associated easement (Parts 1 and 2 on Plan 40R-
19291) was transferred to the Municipality of Clarington through the subdivision
agreement.
2.3 Recently, Official Plan Amendment COPA 2000-002 was approved b the Municipality

allowing the developer to revise the lot configuration for Blocks 137 and 138 to permit
semi-detached dwelling units. This eliminated the need for the rear yard catchbasins.
2.4 Engineering staff have reviewed the revised grading and have approved the design
concept, which requires no catchbasins or easements.

2.5 Since the subdivision agreement makes no specific provision for the release of this
easement, a by-law must be passed by Council, authorizing the release.

Recommendations:
It is respectfully recommended the General Purpose and Administration Committee
recommend to Council the following:

2. THAT the attached list of applications for cancellation, reduction or refund of
taxes be approved; and
3. THAT authorization be granted to write-off amounts below $300.00 rising from
timing differences in application of legislation pertaining to the frozen
assessment listing. I L
Background and Comment:
Pursuant to Sections 441, 442 and 443, Chapter M.45 of the Municipal Act R.S.O. 1990, a list
of applications for cancellation, reduction or refund of taxes is presented to Committee for its .r
review and approval.
Section 442(12) indicates that the Council shall hear and dispose of every application not
later than the 30th day of April in the year following the year in respect of which the
application is made. The last day for making application for the previous year's tax reduction
is the 28th day of February in the following year.
More specifically, under Section 441, the Treasurer shall recommend to Council that
outstanding taxes be stricken from the roll. To strike taxes from the roll it must be by reason
of a decision under Section 442 or 443, or of a decision of a judge of any court or that the
taxes are uncollectible.
An application for a cancellation, reduction or refund may be made for one of the following
reasons:
• Ceased to be liable to be taxed•at rate it was;
• real property becomes exempt;
• razed by fire, demolition or otherwise;
• damaged by fire, demolition or otherwise (substantially unusable)
• removal of a mobile unit;
• inability to pay taxes because of sickness or extreme poverty;

• gross or manifest clerical error;
• repairs/renovations preventing normal use of period of 3 months; and
• business ceases to exist.
The 442 and the 443 process begins when an application is prepared by either the Regional
Assessment Office or the Tax Department. The neighbourhood assessor will perform an on-
site inspection of the property. The assessor will verify the reason for the application, the
period of time, for which the tax relief is claimed, and the amount and type of assessment
that is affected. The application is then sent back to the Tax Department where the actual
tax adjustment is calculated and the taxpayer's account aajusted.

The Section 441 write-offs shown on Schedule 2, represent 1997 Business Taxes deemed
uncollectable. All efforts have been exhausted and in many cases, the business owners
cannot be located.
The total amount of taxes to be written off, for September to December 31, 2000, as shown in
this report total $17,617.14. The grand total for the 2000 tax year is $ 43,255.69. This total
represents the Municipality's share only. For comparison the values of taxes written off
under Section 442 and 443 at December 31, 1999 was $42,967.56 for the municipal portion
only.
Also reflected in the Municipality's write-off account, but not included in this report are
reductions due to Assessment Review Board, Ontario Municipal Board and Court Decisions.
These write-offs, because they are by court decision, are irreversible and final, and are
therefore written off directly to the account and are not required to form part of this report.
This includes minutes of settlement for assessment appeals. At December 31, 2000 this
account (7007-X-252) had a balance of$260,109.58, which is greater than the 2000 budget
amount of$90,000.00. This is higher than 1999 due to write-off taxes for properties acquired
through tax sale and the catch-up of 1998-2000 appeals backlogged at the ARB for
properties in the capped classes. This also includes the Municipality's share of post-cut-off
capping adjustments. Some year end adjustments are still pending on this account. The !
comparative account values at December 31, 1999 for this account were a final balance of
$131,529.79 and a budget value of $90,000.00.

As Council is aware, under Bill 79 (10-5-5 capping legislation), the Municipality must maintain r
a 1997 frozen assessment listing. Changes are retroactively made to this listing for
supplementaries, omits, Assessment Review Board decisions, etc. An individual roll number -
may have been affected by more than one category (ie. ARB and a supplementary). The i
Municipality processes the changes and performs tax adjustments as notices are received
and do not have advance notice of any pending changes. However, the changes to the 1997 j
frozen assessment listing are prescribed to be done in a particular order. Therefore, if the
Municipality receives an ARB decision resulting from an appeal subsequent to processing a
supplementary bill on the property, this would cause a change to the 1997 listing and rec'. .e
recalculation, an already issued supplementary bill. The change is often minor in natui
and only causes further confusion to the taxpayer as to why 1998
Y a appeal would cause an
increased bill for a 2000 supplementary. As a result, staff are recommending that Council
grant authority to write-off these amounts below a threshold of$300.00.

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report p rt ADMIN 03-01 be received; and
2. THAT Council approve the attached Terms of References for the Clarington Agricultural
Advisory Committee; and
i - 3. THAT the Clerk shall advertise the positions of the Agricultural Advisory Committee and
report back to Council.
1. BACKGROUND:
At its meeting held on January 15, 2001, Council passed the followin g resolution:
WHEREAS agriculture has and continues to be an important part of Clarington;
WHEREAS Council wishes to ensure the farming community as a whole will have the
opportunity to communicate with Council in a structured format;

WHEREAS Council wishes to learn, understand and communicate better with the
farming community;
THEREFORE BE IT RESOLVED THAT a Clarington Agricultural/Farm Task Force be
established based on the following:

1. The Mayor and Chief Administrative Officer bring forward a mandate for Council
approval.
2. Farmers be informed through the local press of the information of a task force.
3. That farmers wishing to be members of the task force be invited to submit
applications to the Clerk's Department.

4. That Council select task force members ensuring that there is equal numbers
chosen from each ward within Clarington.
5. The Mayor and Chief Administrative Officer establish the number of members on
the task force.

6. That Councillor Gord Robinson be Council liaison on the task force committee
for this term of Council.
2. COMMENTS:
i
2.1 As per Council's direction, staff prepared the necessary terms of reference for the
Agricultural Advisory Committee as contained in the attachment. The terms of reference

includes the key components such as goal, mandate, scope, composition, meeting and
communication with Council. It is intended to provide general guidance to the
Committee which should have. a fair amount of latitude and flexibility in carrying out its
mandate.
2.2 It should be noted that the team "Task Force" has been renamed to "Advisory
Committee" to reflect Council's intent to have this volunteer group to deal with
agricultural issues on a continuous basis.

2.3 Although the primary mandate of the Advisory Committee is to deal with agricultural
issues, it may occasionally have to deal with conflicts arising out of agricultural and
urban fringe. In this regard, Council may wish to amend the attached terms of reference
by adding two at large urban representatives to the Committee.
2.4 Upon approval by Council, the Clerk will undertake the necessary steps to advertise in
the local newspapers, and to report back to Council which will then make the

CLARINGTON AGRICULTURAL ADVISORY COMMITTEE
TERMS OF REFERENCE
January 18, 2001
1.0 Goal
1.1 To assist the Municipality of Clarington in its efforts to identify, review, discuss
and make recommendations to Council on agricultural and agricultural related —
issues
2.0 Mandate
2.1 The Clarington Agricultural Advisory Committee (CAAC) is a volunteer advisory
committee established by the Municipality of Clarington Council in accordance
with these Terms of Reference. Committee members are bound by these Terms
of Reference and are ultimately responsible to the Municipality of Clarington
Council.
2.2 Scope of Committee Activities
The scope of the CAAC shall include activities such as:
a) To assist the Municipality in the implementation of it's agricultural goals,
objectives and policies;
b) Provide advice, comments and recommendations on issues and concerns of
farmers and agricultural organizations; -
c) Identify key issues of concern for farmers which can be addressed by
municipal government;
d) Provide advice, comments and recommendations on alternative solutions,
approaches, plans or studies dealing with agriculture and related rural issues
which are within the responsibilities and financial capabilities of the
Municipality of Clarington;

e) Monitor and report on changes within the agricultural industry including
agricultural land inventory;
f) Identify and implement programs which encourage public awareness, land
stewardship and education of agricultural and rural issues;
Inform individuals t
g) , groups and businesses of the Municipality's agricultural
goals, objectives and policies;

h) Provide advice, comments and recommendations as requested by the
Municipality of Clarington Council on miscellaneous matters as they arise;
i) Consult with other community groups and committees on issues of mutual
interest.
3.0 Committee Composition
3.1 The Clarington Agricultural Advisory Committee shall consist of nine (9)
voluntary members who are appointed by Council for a term of three (3) years, to
coincide with the term of Council. A majority of the membership five (5) shall
constitute a quorum.

f 3.2 Members of the Committee are appointed as voluntary representatives of a
particular interest group, agency or organization or as members at large, as
follows:
a) Municipal Council Liaison(Gord Robinson)
b) Durham Federation of Agriculture Representative (1)
c) Two agricultural representative from each Ward (a total of 8)
3.3 The members shall possess expertise, experience and willingness to devote the
necessary time to the Committee. Members will be selected to provide an
appropriate representation of various farming interests (dairy, beef, apple,
greenhouse, cash crops, ho poultry,p � g, p ry, etc.)
3.4 Openings for membership shall be publicly advertised. All residents and any
_ nominated representative of an organization involved in agricultural and rural
issues are invited to apply.1 Applicants will submit the required application form
to the Municipality of Clarington Clerks Department. Applicants shall possess
knowledge of agricultural issues within Clarington. Applicants may also possess;
relevant farm experience, technical training in an agriculture-based field, and/or
current involved in agricultural community activities. Members will be formally
appointed by Municipal Council.

3.5 A Chair and Vice-chair shall be appointed by the Committee and must be a
member of the Committee.
3.6 A recording secretary shall be appointed at the first meeting. Duties of the
recording secretary shall include the taking of meeting minutes and providing
these minutes to the Clerk for Council's information.
4.0 Meetings and Reporting
4.1 The Clarington Agricultural Advisory Committee shall determine the location
and frequency of meetings. Committee members, if absent for three consecutive
meetings without reason being given at least 24 hours in advance of the meeting,
should be considered to have lost interest in the Committee and will be informed
of his or her being removed from the Committee. If any member is dropped =
from the Committee or resigns from the Committee,. the Clerk of the
Municipality of Clarington shall be informed and a new member shall be
appointed by Council.
4.2 The Committee, by resolution or through its Chair, may invite any individual,
interest group, agency or staff to appear at a meeting as a delegation or to submit
or present information that will assist the Committee in carrying out its mandate.
5.0 Communicating with the Municipality !-
5.1 Minutes of the Committee shall be submitted by the recording secretary to the
Municipal Clerk for inclusion in the Council agenda for information.

5.2 Recommendations from the Committee shall be submitted to the Municipal Clerk
for inclusion in Council agenda for direction.
5.3 The Council representative shall be the liaison person between the Committee and
Municipal staff.
