THAT Report PD-1-87 be received; and 2. THAT the request submitted by Mr. B.P. Stelrnach, on behalf of Walter Schleiss and Raymond D. Holland, thereby exempting Lots 37, 38 and 39, Lots 64 to 76, 79 to 100, (inclusive), and Lots 101 to 103 (inclusive), as shown on the Plan lOM-787 from Part Lot Control be acknowledged; and 3. THAI~~the attached by-law be approved and forwarded to the Regional Municipality of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and 4. THAT Mr. B.P. Stelrnach be so advised. BACKGROUND AND COMMENT: A request was received by Staff from Mr. B.P. Stelrnach acting on behalf of Schleiss and Holland for an exemption from Part Lot Control in respect of Lots 37, 38 and 39, Lots 64 to 78, 79 to 100 (inclusive), and 101 to 103 (inclusive) in registered Plan of Subdivision lOM-787. ...2 ~~a' REPORT NO.: PD-1-87 Page `L Staff would note that draft approval has been amended, as endorsed by Council at the July 28, 1986 meeting, to revise Lots 77 and 78 to permit the development of single famly homes. Accordingly, Mr. Stelrnach's request has been altered by deleting Lots 77 and 78. Staff have reviewed the request and would have no objection to same and the approval of the by-law exempting the subject lands within this Plan from Part * Lot Control. In that regard, attached hereto is a by-law which requires approval of Council and the Regional Municipality of Durham which would exempt the subject lands from Section 49(5) of the Planning Act pursuant to the provisions of Section 49(7) of said Act. Accordingly and in order to facilitate conveyance of title of the individual semi-detached dwellings located on these lots, it would be appropriate for the Council to approve the necessary exemption from Part Lot Control. WHEREAS the Council of the Town of Newcastle deems it desirable to exempt, from Part Lot Control, Lots 37, 38 & 39, 64 to 76, 79 to 100 (inclusive), and Lots 101 to 103 (inclusive) on Plan lOM-787, registered at the Land Registry Office for the Land Registry Division of Newcastle (No. 10) on November 7, 1986; NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. That Subsection (5) of Section 49 of the Planning Act shall not apply to those lands described in Schedule "A" to this by-law. 2. This by-law shall come into effect upon being approved by the Regional Municipality of Uurham, and thereafter Subsection (5) of Section 49 shall cease to apply to the lands described in Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this by-law. BY-LAW read a first time this day of 1987. BY-LAW read a second time this day of 1987. Holland respecting the above-noted development. ~_ Some of the builders that are purchasing lots from my Clients wish to build semi-detached and link dwelling units on the subject lots. The specific lots involved are Lots 37,38 and 39, Lots 64 to 78 inclusive, Lots 79 to 100 inclusive, and Lots 101 to 103 inclusive. I understand that in order to do so, we require a by-law from the Town of Newcastle in this regard. I would ask you to kindly advise me what is necessary to obtain the same or advise as to which department I should contact.
