Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-67-98 be received ;
2. THAT Rezoning Application DEV 98-032 submitted by George L. Smith, on behalf
of Halminen Building Corporation (Clarington), requesting the removal of the
"Holding (H)" symbol from the subject lands be APPROVED;
3. THAT the amending By-law attached hereto be forwarded to Council for approval;
4. THAT a copy of this report and the amending By-law be forwarded to the Region of
Durham Planning Department; and
5. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

2. BACKGROUND
2.1 In May 1998, an application was received by the Municipality of Clarington
Planning and Development Department requesting removal of the "Holding (H)"
symbol from the lands associated with consent applications (LD 017/98 to 019/98
inclusive). The subject lands are located in Part Lot 33, Concession 2, former
Township of Darlington.
2.2 The Land Division Committee heard applications LD 017/98 to LD 019/98 inclusive
at its regular meeting on January 12, 1998. Application LD 017/98 and LD 018/98
were both approved as applied for, while LD 019/98 was TABLED. LD 017/98
proposes the creation of a 14.32 metre frontage lot, for single family dwelling
purposes fronting on Prestonvale Road. LD 018/98 proposes to sever 40 metres
from the rear of the subject property to create asemi-detached/link dwelling lot,
with 25 metres of frontage on Renwick Road. LD 019/98 proposes to sever the 25
metre semi-detached/link lot in half. This last application will be dealt with after
building permits for the two semi-detached/linked dwellings have been issued. The
retained parcel contains an existing dwelling and is known as 2616 Prestonvale
Road. The lot is proposed to have a frontage of 14.33 metres.
3. COMMENTS
3.1 The subject property is presently zoned "Urban Residential Type One" and
"Holding-Urban Residential Type One ((H)R1). The (H)R1 zone impacts the rear
half of the applicant's property. The provisions of the Zoning By-law allow for the
removal of the "Holding (H)" symbol, by By-law, upon Council being satisfied that
the uses to be permitted will be adequately serviced, have appropriate access, and
will be used for the purposes intended by the By-law.
3.2 The removal of "Holding (H)" was a condition of the consent applications. The
applicant has satisfied all other conditions related to the consent applications. The
Region of Durham Planning and Works Departments also supported the severance

applications. The subject lot can be serviced from both Prestonvale Road and
Renwick Road respectively and access permits have been applied for.
3.3 It is noted that pursuant to Section 36 of the Planning Act, a By-law Amendment to
remove the "Holding (H)" symbol is not subject to the normal appeal period
afforded to a standard rezoning application, and accordingly shall be deemed final
and binding should Council grant approval of same.
4. RECOMMENDATION
4.1 Inconsideration of the comments noted above, Staff would have no objection to the
removal of the "Holding (H)" symbol as shown on the attached By-law and
Schedule.

BY-LAW NO. 98-
Being a By-law to amend by-law 84-63, the Comprehensive Zoning By-law of the
Corporation of the former Town of Newcastle
WHEREAS, the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of
Newcastle for Dev 98-032.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule°4" to By-law 84-63, as amended, is hereby further amended by changing
the zone designation from "Holding-Urban Residential Type One ((H)R1)", to
"Urban Residential Type One (R1)", as illustrated on the attached Schedule "A"
hereto.
2. Schedule "A" attached hereto shall form part of this By-law.
3. This By-law shat I come into effect on the date of the passing hereof, subject to the
provisions of Sections 34 and 36 of the Planning Act.
