SERNAS ON BEHALF OF THE QUADRILLIUM CORPORATION PART LOT 11, CONCESSION 2, FORMER TOWN OF BOWMANVILLE SOUTHWEST OF THE LIBERTY ST./CONCESSION RD. 3 INTERSECTION FILE NO.: 18T-87021 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: THAT Report PD-46-98 be received ; 2. THAT the application for revisions to Draft Approval for Plan of Subdivision 18T- 87021, submitted on behalf of the Quadrillium Corporation be referred back to staff for further processing and the preparation of a subsequent report following the receipt of the outstanding agency comments; and 3. THAT within 15 days of the Public Meeting, the Commissioner of Planning for the Region of Durham be advised and provided, by sworn declaration from the Clerk the following: i) that the Municipality held a Public Meeting in accordance with Section 51 (21.1) of the Planning Act for the subject subdivision application; ii) a copy of the minutes of said meeting; iii) a copy of all written submissions received by the Municipality; iv) a list of all persons and public bodies, including their mailing addresses, which made oral submissions at the public meeting, or written submissions; and v) a copy of the report and the Council decision. 4. THAT all interested parties listed in this report and any delegations be advised of Council's decision. - 601 REPORT NO.: PD-46-98 PAGE 2 1. APPLICATION DETAILS 1.1 Owners: The Quadrillium Corporation 1.2 ApplicandAgent: G. M. Sernas & Associates Ltd. 1.3 Revisions to Draft Approval: • to develop 1 single detached dwelling unit; and • to develop 102 semi-detached dwelling units in place of 61 single detached dwelling units for a total of 42 additional low density dwelling units in the southern portion of the subdivision lands (see Attachment #2) 1.4 Entire Plan of Subdivision Area: 17.783 hectares (43.941 acres) 2. BACKGROUND 2.1 On December 19, 1997, the Planning and Development Department received an application to amend draft approved plan of subdivision 18T-87021 in order to permit the revisions described in Section 1.3 of this report. On January 13, 1998, the Planning and Development Department was advised by the Region of Durham of an application to amend draft-approved plan of subdivision 18T-87021. 2.2 The area subject to the proposal is located southwest of the Liberty Street and Concession Road 3 intersection. The more formal location description is Part Lot 11, Concession 2, former Town of Bowmanville (see Attachment #1). 3. 3.1 3.2 EXISTING AND SURROUNDING USES The site is currently vacant. The surrounding land uses are as follows: North-vacant lands, 1 church and 4 scattered single detached dwellings South- vacant lands, and semi-detached and single detached dwellings 602 REPORT NO.: PD-46-98 PAGE3 East - 1 single detached dwelling west of Liberty Street, and east of Liberty Street -the Liberty Village subdivision which includes townhouse, semi-detached and single detached dwelling units West- vacant 4. PUBLIC NOTICE AND SUBMISSION 4.1 Pursuant to Council's resolution of July 26, 1982, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the appropriate notice was mailed to each landowner within the prescribed distance. 4.2 As a result of the public notification process, to date, the Planning and Development Department has received no inquiries or written submissions. 5. OFFICIAL PLAN CONFORMITY 5.1 Within the Durham Regional Official Plan, the subject property is located within the Bowmanville Urban Area and is designated as Living Area. The application conforms. 5.2 Within the Clarington Official Plan, the subject property is designated as Urban Residential. The application conforms. 6. ZONING BY-LAW COMPLIANCE 6.1 Within Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, the area of the proposed revisions to draft approved plan of subdivision 18T-87021 is zoned Holding -Urban Residential Type One ((H)R1). Since this zone permits both single detached and semi-detached dwellings, the application conforms. 7. AGENCY COMMENTS 7.1 The rezoning application was circulated to various agencies and other departments 6~3 REPORT NO.: PD-46-98 PAGE 4 by the Planning and Development Department. Comments received to date are as follows. 7.2 The Clarington Fire Department had no objection. 7.3 Clarington Hydro stated capacity is available to the area and that it will provide comments specific to the proposed subdivision when it receives a design from the developer. 7.4 Comments remain outstanding from the Central Lake Ontario Conservation Authority. 8. STAFF COMMENTS 8.1 As the purpose of this report is to give the status of the application for the public meeting, it is appropriate to have the application referred back to staff for further processing.
