Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-45-98 be received;
2. THAT staff be authorized to proceed to commence a process to amend the former
Town of Newcastle By-law to prohibit Charity Gaming Club and Video Lottery
Terminals (VLT).
REPORT
1. At its meeting held on March 30, 1998, Council adopted the following resolution:
'THAT the Municipality of Clarington advise the Province of Ontario that it does not
want a Charity Gaming Club to locate within the boundaries of the Municipality
of Clarington".
2. In recognition of Council's expressed position of the subject matter, staff
examined the Zoning By-law and wish to advise that our by-law does not
specifically prohibit a Charity Gaming Club. Such a use could be interpreted as
a form of activity that would be permissable within any place of assembly or
within a general commercial zone.
3. Although the Planning Department has not received any applications for a charity
gaming club and/or video lottery terminal, it would appear prudent that the

Municipality should take that extra step to amend the Zoning By-law so as to give
legal effect to the Council's resolution to make it absolutely clear that the use of
land and building for a charity gaming club and/or video lottery terminal would
not be permitted in any zone within the Municipality of Clarington.
4. Accordingly, staff is recommending Council to authorize staff to commence a
process to amend the Zoning By-law.
5. Upon Council's approval and in accordance to the procedure set out in the
Planning Act, notice will be placed in all local newspaper to advise of a public
meeting date when the proposed by-law amendment will be considered by
Council.
