Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-42-98 be received ;
2. THAT application to amend the Draft Approval for Plan of Subdivision 18T-88046
be approved subject to the red-line revisions as contained in attachment No. 2.
3. THAT a copy of this Report and Council's decision be forwarded to the Region of
Durham Planning Department; and
4. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: West Bowmanville Developments Ltd. (The Kaitlin Group Ltd.)
1.2 Agent: Design Plan Services Inc.
1.3 Revisions to Draft Approval:
To add a 0.34 ha parcel of land to the existing Draft Approved plan of
subdivision, which together with future development blocks 302 and
303 would permit the creation of five semi-detached/linked lots (10
units).
1.4 Land Area: 0.34 ha (0.84 acre)

2. LOCATION
2.1 The lands subject to the proposed red-line revision are located on the north east
side of Abernethy Crescent between house numbers 29 and 51 Abernethy Crescent.
The lands are further described as being located in Part Lots 15 and 16, Concession
1, formerTownship of Darlington (See Attachment No. 1).
3. BACKGROUND
3.1 The surrounding residential areas were originally Draft Approved in February 1991.
The original Draft Approval was for a total of 889 units over 53.68 ha. Since 1991,
the owner has received approval for five (5) separate red-line revisions to Draft
Approval. The most recent being February 9, 1998. The current total number of
Draft Approved units is now 930, on 55.28 ha.
3.2 The proposed application for amendment to Draft Approval was received by the
Planning and Development Department on March 6, 1998. As noted above, the
lands being added to the subdivision, together with two (2) existing future
development blocks would allow the creation of five (5) semi-detached/linked lots
(Attachment No. 2). Should the proposed amendment to Draft Approval be
approved, the applicant intends to further divide these lots, through the submission
of an application for Part Lot Control to create a total of 10 units.
3.3 The applicant applied to the Durham Land Division Committee to create the subject
five (5) lots (LD 190/97 to 193/97 inclusive). The applications were in fact
approved by the Land Division Committee in July 1997, and the applicant has
fulfilled all conditions. Notice that the new Deeds have been stamped was received
by the Municipality on January 30, 1998.
3.4 Although the current application to amend Draft Approval appears to duplicate the

efforts recently completed through the consent process, it was at the applicant's
request that the five (5) lots be included within the limits of the Plan of Subdivision.
Once the lands are included within the limits of the Plan of Subdivision, an
application for Part Lot Control could be submitted to the Municipality following
the construction of the semi-detached/linked units rather than re-applying through
the Land Division Committee, to sever each lot in half.
4. OFFICIAL PLAN POLICIES
4.1 Within the Durham Region Official Plan the subject property is designated Living
Area. The proposed residential use is permitted.
4.2 Within the Clarington Official Plan the subject property is designated urban
Residential. The proposed residential lots are permitted. The application appears to
be inconformity with the policies of both Plans.
5. ZONING
5.1 Within the Municipality's Comprehensive Zoning By-law the subject property is
zoned "Urban Residential Type One (R1)" and "Holding -Urban Residential Type
One ((H)R1". The "R1"zone permits both single family dwelling lots and semi-
detached linked lots. The proposed lots created through this application for
Amendment to Draft Approval would comply with the "R1"zone. The Holding (H)
symbol must be removed from the former block 303, prior to the development
(issuance of building permit) for proposed lot 410.
6. STAFF COMMENTS
6.1 The principle of creating the five additional lots (10 units) is consistent with the
original Draft Approval, and was in essence supported by the Municipality through
the consent applications approved in July 1997. Clarington Public Works was the

only department circulated by Planning Staff and they have no objection and no
conditions of approval on the proposed amendment.
6.2 The five (5) lots have recently been created through the consent process, which
included a Public Meeting. As a result, staff did not deem it necessary to have a
Public Meeting specifically for this proposed revision to Draft Approval.
7. CONCLUSION
7.1 Inconsideration of the comments contained above, it is recommended that
Committee and Council support the proposed amendment to Draft Approved plan of
subdivision 18T-88046, as red-line revised in Attachment No. 2, and the conditions of
Draft Approval as contained in Attachment No. 3.

REVISED CONDITIONS OF DRAFT APPROVAL FOR FINAL PLAN REGISTRATION
1. That Condition No. 1 be deleted in its entirety and replaced with the following:
"That this approval applies to draft plan of subdivision 18T-88046, prepared by
Design Plan Services Inc., identified as drawing number B-8725-3/98, dated
February 23, 1998, as further red-line revised, illustrating 185 single family dwelling
lots, 154 semi-detached/linked lots for 308 units, 165 on-street townhouse units, 2
blocks for 282 apartment units, and various blocks for local central area, public
elementary school, neighbourhood parks, open space, walkways, road widenings,
0.3 metre reserves and future development blocks."
