Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-40-98 be received;
2. THAT the application to amend Comprehensive Zoning By-law 84-63 of the former
Town of Newcastle, submitted by Glen and Barbara Parks, be referred back to
staff for further processing and the preparation of a subsequent report following
the receipt of the outstanding agency comments; and
3. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

2. BACKGROUND

2.1 On February 13, 1998, the Planning and Development Department received an
application to amend Zoning By-law 84-63 in order to permit the division of one
(1) residential lot into two (2) residential lots.
2.2 The area subject to the proposal is located on the southeast corner of the T-
intersection of Sunny Ridge Trail and Holt Road in southwestern Enniskillen. The
municipal street address is 5 Sunny Ridge Trail, Enniskillen. The more formal
location description is Part Lot 20, Concession 7, former Township of Darlington.
3. EXISTING AND SURROUNDING USES
3.1 The site is currently vacant.
3.2 The surrounding land uses are as follows:
North - a residence
South - vacant
East - vacant
West - unopened portion of Holt Road and beyond this road,
Enniskillen Conservation Area
4. PUBLIC NOTICE AND SUBMISSIONS
4.1 Pursuant to Council's resolution of July 26, 1982, and the requirements of the
Planning Act, the appropriate signage acknowledging the application was installed
on the subject lands. In addition, the appropriate notice was mailed to each
landowner within the prescribed distance.
4.2 As a result of the public notification process, to date, the Planning and
Development Department has heard from sixteen (16) individuals who together
have made a total of two (2) counter inquiries, eight (8) telephone inquiries and
seven (7) written submissions.

4.3 The counter inquiries focussed on: application background information, including
the Gibson & Associates Ltd. Lot Servicing Study and the Circulation List; existing
and potential zoning; the potential for additional lot division within registered plan
10M-815; the status of Cambrian Road and Holt Road south of the intersection
with Sunny Ridge Trail; and the supply of vacant one (1) acre and two (2) acre
lots in northern Darlington.
4.4 The telephone inquiries and written submissions were concerned with: the basics
of the rezoning application process; the earlier Planning Department requirements
and. recommendations, and Council adoption of the two (2) acre layout for the
subdivision; the possibility of the Parks rezoning setting a precedent and smaller
lots leading to smaller houses, thereby undermining the property values and the
aesthetics of the Sunny Ridge Trail neighbourhood; Sunny Ridge Trail being
chosen as a place of residence because of the two (2) acre lot sizes and
corresponding luxury homes; existing and potential zoning; the Sunny Ridge Trail
Subdivision Agreement; the subdivision developer - Mr. Goheen objecting to the
rezoning; the unfairness of the rezoning to existing residents; the presence of
more houses conflicting with the atmosphere and uses of the neighbouring
conservation area; and the supply of vacant one (1) acre and two (2) acre lots in
northern Darlington.
5. OFFICIAL PLAN CONFORMITY
5.1 Within the Durham Regional Official Plan, the subject property is located within
the Hamlet of Enniskillen. The application conforms.
5.2 Within the Clarington Official Plan, the subject property is designated Hamlet
Residential. The application conforms to the land use designation.
6. ZONING BY-LAW COMPLIANCE
6.1 Within Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, the
subject property is zoned Residential Hamlet Exception (RH-3). The division of

one (i) .83 ha residential lot into two (2) residential lots of approximately .4 ha
each is not allowed in this zone which has a minimum lot area of .8 ha.
6.2 The rezoning application is needed to permit the creation of, through severance
of the existing lot, two .4 ha lots.
7. AGENCY COMMENTS
7.1 The rezoning application was circulated to various agencies and other
departments by the Planning and Development Department. Comments received
to date are as follows.
7.2 The Clarington Fire Department and Ontario Hydro had no objection.
7.3 The Regional Health Department has investigated this application and does not
recommend approval at this time. The subject property is in a registered plan of
subdivision and a nitrate impact loading study for the plan of subdivision was
conducted on the set number of lots within the subdivision. The lots were sized
so that the acceptable limit would be met. If this lot is allowed to be severed
these limits may not be met and the potable water from the wells for the lots may
adversely be affected.
7.4 The Regional Planning Department notes the subject property is designated
"Hamlet" in the Durham Regional Official Plan which allows for avariety of housing
types and limited infilling. The same Plan indicates that development within
hamlets shall be individually serviced with private drilled wells and private sewage
disposal systems where groundwater quality/quantity permits and in compliance
with the standards of Durham Region and the Ministry of the Environment.
7.5 Comments remain outstanding from: The Clarington Public Works Department,
Central Lake Ontario Conservation, the Public School Board and the Separate
School Board.

8. STAFF COMMENTS
8.1 Staff notes the land division which would follow approval of a rezoning of the
subject property, if such an approval were granted, would set a precedent for a
number of other lots in this 22 lot subdivision. All of the lots exceed 0.8 ha in size
and seven (7) of the lots are vacant.
8.2 As the purpose of this report is to give the status of the application for the Public
Meeting, it is appropriate to have the application referred back to staff for further
processing.
