Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-24-98 be received;
2. THAT the request for removal of Part Lot Control in respect of Lot 1 on 40M-1688
and Block 96 on 10M-830 be APPROVED;
3. THAT the attached By-law be APPROVED and forwarded to the Regional
Municipality of Durham pursuant to Section 50 (7.1) of the Planning Act, R.S.O.
1990, as amended;
4. THAT By-law 97-162 be repealed; and
5. THAT all interested parties listed in this report and any delegation be advised of
Council's decision.
1. BACKGROUND
1.1 Registered Plans of Subdivision 10M-830 and 40M-1688 are located in Part Lot
9, Concession 2, in the former Town of Bowmanville (See Attachment No. 1). On
July 7, 1997, Council considered a report and approved By-law 97-162 requesting
removal of Part Lot Control. The purpose of the application was to reconfigure
Lot 1 of 40M-1688 and Block 96 of 10M-830 to allow development of two, 15
metre (50 ft.) minimum frontage, single family dwelling lots.

1.2 The By-law attached to Staff Report PD-102-97, incorrectly referenced registered
Plan of Subdivision 40M-1668, as opposed to 40M-1688. As a result the ability
to divide the property as originally proposed could not be completed. Inasmuch
as staff did not object to the original application, it is recommended that the
attached new By-law be adopted and By-law 97-162 be repealed.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 98-
being a By-law to designate a certain portion of Registered
Plan lOM-830 and Registered Plan 40M-1658 as not being
subject to Part Lot Control and to repeal By-law 97-162.
WHEREAS the Council of the Corporation of the Municipality of Clazington deems it
advisable to exempt from Part Lot Control, Block 96 on Plan lOM-830 and Lot 1 on Plan
40M-1688 now both registered at the Land Titles Division of Durham.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. THAT Subsection (5) of Section 50 of the Planning Act shall not apply to those
lands described ht Paragraph 2 within the By-law.
2. THAT this By-law shall come into effect upon being approved by the Regional
Municipality of Durham and thereafrer Subsection (5) of Section 50 shall cease to
apply to the following lands:
(a) Block 96 on Plan lOM-830 and Lot 1 on 40M-1688, Municipality of
Clazington, Regional Municipality of Durham.
3. Pursuant to Subsection 7.3 of Section 50 of the Planning Act, this By-law shall be in
force for a period of three (3) years ending on July 7, 2000.
4. By-law 97-162 is hereby repealed.
