REPORT Meeting: General Purpose and Administrative Committee File #~~ Date: Monday, February 2, 1998 Res. #~~~ V ~ Report #: PD-17-98 File #: By-law # Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF JANUARY 22, 1998 FILES: A98/002 AND A98/003 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD-17-98 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on January 22, 1998 for applications A98/002 and A98/003; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decision of the Committee of Adjustment for applications A98/002 and A98/003 in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee approved both (2) applications heard at the January 22, 1998 meeting. 1.2 The purpose of each minor variance application and the Committee's decision are detailed in Attachment No. 1. 1.3 Staff have reviewed the Committee's decisions and are satisfied that the Committee's decision to approve the applications are in conformity with the Official Plan policies, consistent with the intent of the Zoning By-law, minor in nature and desirable. b74 Y REPORT NO. PD-17-98 PAGE 2 1.4 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment. 1.5 As this was the first meeting of the newly appointed Committee of Adjustment (following Council elections in the fall of 1997), motions were taken and approved for various positions. Tom Sheehan has been appointed as Chairman, Jean- Michel Komarnicki has been appointed as Vice-Chairman, Susan Leonowicz has been appointed as Secretary-Treasurer and Isabel Little has been appointed as Acting Secretary-Treasurer. These appointments are for the current term of the Committee.
