THAT Report PD-5-98 be received; 2. THAT the application to amend Comprehensive Zoning By-1aw84-63, as amended of the former Town of Newcastle submitted by Patrick Bannister, to remove the "Holding (H)" symbol from the subject lands be APPROVED; 3. THAT the attached amendment to Zoning By-law 84-63 be approved; and 4. THAT the Region of Durham Planning Department and all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: Patrick Bannister 1.2 Rezoning: From "Holding -Urban Residential Type One ((H)R1)" to "Urban Residential Type One (Ri)" 1.3 Area: 540 mz 2. LOCATION 2.1 The subject property is located in Part Lot 30, Concession 1, former Village of Newcastle. The parcel subject to rezoning is the south west portion of 385 King Street West (see attached by-law). ~ _, REPORT NO. PD-5-98 PAGE 2 3. BACKGROUND 3.1 On August 6, 1997, an application for rezoning was submitted to the Municipality. On September 4, 1997, the Municipality received notice that the applicant has also filed application for land division (LD 244/97). The latter application would create a lot for residential purpose by severing the southwest portion of 385 King Street West. There is an existing house on the property which has frontage on Highway 2 and which would remain after the lot is severed. The severed lot would have frontage on Lillian Crescent and permit the construction of a single family dwelling. 3.2 The application for land division was heard and approved on October 6, 1997. Removal of the Holding symbol was one of the Municipality's conditions of approval. The removal must occur prior to the creation of the lot. 4. EXISTING AND SURROUNDING USES 4.1 Existing Use: residential 4.2 Surrounding Use: East - residential West - residential North - residential South - residential 5. OFFICIAL PLAN POLICIES 5.1 The subject land is designated "Living Area" within the Durham Region Official Plan and "Urban Residential" within the Clarington Official Plan. The proposed residential use conforms with both official plans. 6. ZONING BY-LAW PROVISIONS 6.1 Within Comprehensive Zoning By-law 84-63, as amended, of the former Town of Newcastle, the lot to be severed is zoned "Holding -Urban Residential Type One ((H)Ri)". The Holding symbol can only be removed once all servicing and planning concerns have been addressed. Upon creation of the lot through the land division process, residential development can proceed. V J REPORT NO. PD-5-98 PAGE 3 7. AGENCY COMMENTS 7.1 In accordance with departmental procedures, the application was circulated to obtain comments from other departments and agencies. No objections were received. 8. STAFF COMMENTS 8.1 Staff advise that the Holding (H) Symbol may be removed upon Council being satisfied that the uses to be permitted will be adequately serviced, have adequate access and will be used for purposed intended by the By-law. In reviewing the proposal, staff are satisfied that the conditions required for the removal of holding have been met. 9. CONCLUSIONS 9.1 Given the above comments, staff would have no objection to the removal of the Holding (H) symbol as shown on the attached by-law and schedule. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of Newcastle. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: Schedule "6" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from: "Holding -Urban Residential Type One ((H)R1)" to "Urban Residential Type One (Rt )" as illustrated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Sections 34 and 36 of the Planning Act. BY-LAW read a first time this day of 1998.
