LOCATION 2.1 The subject property is located on the south side of Lake Road in what is commonly referred to as the `South Bowmanville Industrial Park'. The property will be municipally known as 405 Lake Road and is located in Part Lot 8, Broken Front Concession. f / REPORT NO.: PD-3-98 PAGE 2 3. BACKGROUND 3.1 The rezoning application was received by the Municipality of Clarington Planning and Development Department on December 5, 1997. The applicant proposes to rezone the referenced property to permit an automotive recycling facility within an enclosed building. The Building: The proposed building will have a foot print of 5508 sq/m (59290 sq./ft). The proposed structure will have a centre court, open to the sky, measuring 18 metres by 66 metres (see Attachment No. 2). Therefore the actual floor area of the building is proposed to be 4320 sq/m (46500 sq/ft). The Recycling Operation: The applicant submitted a planning and information report which detailed the proposed recycling process and components of the proposed facility. Excerpts of this report are contained in Attachment No. 3. The proposed facility will receive vehicles for the auto recycling operation by transport truck. The applicant has stated the vehicles will be unloaded at the rear of the building and stored in the `centre court' while awaiting to be dismantled at rate of approximately 8 cars per day. The various components will be catalogued and shelved. Components will be sold "over the counter" on-site, delivered to licensed body shops or service stations, and/or placed in container boxes for overseas shipping. Oils removed from the vehicles will be used for heating the building, while fuel, anti-freeze and brake fluids will be filtered and re-used. Car seats, tires and glass will be re-sold or re-cycled to LASCO along with the chassis of the vehicles. 4. EXISTING AND SURROUNDING USES 4.1 The existing site is currently vacant 4.2 Surrounding land use are as follows: Y"" REPORT NO.: PD-3-98 PAGE 3 South: Canadian National Railway and vacant lands East: vacant lands draft approved for industrial development North: bulk fuel storage facility and vacant industrial lots West: limited industrial development and vacant industrial lots 5. PUBLIC MEETING AND RESPONSE 5.1 Pursuant to the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, notice was mailed to each landowner and tenant within the 120 metre prescribed distance. As of the writing of this report no enquiries with regards to the application have been received. 6. OFFICIAL PLAN POLICIES 6.1 Within the Durham Regional Official Plan the subject property is designated Employment Area. Lands designated as such shall be used for an array of uses including manufacturing, assembly and processing of goods, service industries, and warehousing. The application would be deemed to conform. 6.2 Within the Municipality of Clarington Official Plan the subject property is designated Light Industrial. The predominant use of lands so designated shall be manufacturing, assembling, processing, fabricating, repairing, research and development, and warehousing. Outside storage is limited to 25% of the total gross building floor area, less than 3 metres high and located in well screened locations, generally at the rear of the building. The applicant's are not proposing to have any outside storage on site. The "centre court" of the building, although open to the sky, is contained within the centre of the building. The application is deemed to conform. 7. ZONING 7.1 The current zoning on the subject property is "General Industrial (M2)". Under the ~i REPORT NO.: PD-3-98 PAGE 4 current zoning by-law the M2 zone category provides the widest range of permitted industrial uses. However, the description of the proposed operation best complies with the term `Motor Vehicle Wrecking Yard', as defined in the Zoning By-law. This term is defined in part as, "shall mean an establishment where scrap motor vehicles are stored and/or dismantled and where used motor vehicle parts are sold". This use is not listed as a permitted use within the M2 zone, hence the need for rezoning. 8. AGENCY COMMENTS 8.1 In accordance with departmental procedure the subject application was circulated to a number of agencies and departments for comment. To date comments remain outstanding from the majority of the circulated agencies/departments. 8.2 Both the Clarington Hydro Electric and the Fire Department have advised they have no objection to the proposal. 9. STAFF COMMENTS 9.1 The applicant filed at this time is for rezoning only. Should the rezoning be successful an application for site plan approval is required prior to development to the site proceeding. 9.2 The proposed automobile dismantling/recycling facility is to be a fully enclosed operation, and all delivery of vehicles and loading of parts will be done through the loading doors at the rear of the building. The developer/owner is required to comply with Ministry of Environment regulations regarding re-use of oils, fuels, tires, etc. However, the Ministry of the Environment does not issue any specific certificate for the recycling or dismantling of automobiles. ''~ REPORT NO.: PD-3-98 PAGE 5 10. CONCLUSION 10.1 The purpose of this report is to facilitate the Public Meeting as required by the Planning Act, and to provide Committee and Council with some background on the application submitted. It is recommended the application be referred back to Staff for further processing and subsequent report upon receipt of all outstanding comments and resolution of any issues which may arise.
