Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-158-97 be received;
2. THAT in consideration of the application submitted fora Zoning By-law
Amendment, filed by Melody Homes, for the development of a convenience store
on the south-east corner of Freeland Drive and Swindells Street, no further action
be taken with respect to commercial development at the south-east corner of
Liberty Street and Concession Road 3.
3. THAT the interested parties listed in this report and any delegation be advised of
Council's decision.
2. BACKGROUND
2.1 At the October 14, 1997, Council Meeting, Mr. Viv Woolford requested Council
consider the approval of a convenience store on the vacant lot on the south-east
corner of Liberty Street and Concession Road 3. Mr. Woolford, who resides at
18 Hooper Square (see Attachment No. 1), noted that the closest convenience
store is a 35 minute walk from the Liberty Village subdivision and the growth in
the area warrants the inclusion of a convenience store.
2.2 In response to Mr. Woolford's delegation, Council endorsed the following
resolution:

'THAT a report be presented to the General Purpose and Administration
Committee on the process required for approval of a mini-plaza at the corner of
Liberty Street and Concession Road 3."
3. PLANNING COMMENTS
3.1 On October 30, 1997, members of the Planning Department met with Mr. Savario
Montemarano, of Melody Homes, his architect, and former Regional Councillor
Anne Dreslinski to discuss the possibility of a commercial development, with
approximately 650 m2 (7000 sq. ft.) of floor area on the south-east corner of
Liberty Street and Concession Road 3. The property is designated Urban
Residential in the Official Plan and is zoned Urban Residential Type Three (R3).
3.2 Staff explained that the Clarington Official Plan provides a hierarchy of commercial
designations. To service residential areas within the Municipality, two types of
commercial designations are found on the Land Use Schedule of the Official Plan;
Local Central Areas, and Neighbourhood Commercial. The latter permits a
maximum of 1000 m2 of gross leasable floor area for retail and personal services
uses. Mr. Montemarano was further advised that a convenience store of up to
100 mz (1076 sq. ft.) is permitted within the Urban Residential designation subject
to rezoning.
3.3 Mr. Montemarano and his architect were advised that inasmuch as the property,
at the southeast corner of Liberty Street and Concession Road 3, does not have
a commercial designation as described above, development of the site fora 650
mz plaza would require an Official Plan Amendment, as well as a Zoning By-law
Amendment and Site Plan Approval.
3.4 During the meeting the Bowmanville Land Use Schedule of the Clarington Official
Plan was reviewed in terms of the commercial designations in and around the
Liberty Village subdivision (see Attachment No. 2). The following areas currently
have a commercial designation:

• Neighbourhood Commercial designation at the southwest corner of Liberty
Street and Concession Road 3;
• Neighbourhood Commercial designation atthe southwest cornerof Mearns
Avenue and Concession Road 3, this property is part of the Melody Homes
subdivision;
• Neighbourhood Commercial designation on the south side of the
Longworth Avenue extension between Liberty Street and Mearns Avenue;
and
• Local Central Area designation at the intersection of Liberty Street and
Longworth Avenue on the west side of Liberty Street.
3.5 Staff advised Mr. Montemarano that in consideration of the designated Local
Central Area and Neighbourhood Commercial siteswithin the vicinity ofsouth-east
corner of Liberty Street and Concession Road 3, staff would have difficulty
supporting a further commercial designation in this area.
3.6 The possibility of submitting a rezoning and site plan approval application to
develop a corner store with a maximum of 100 m2 (1076 sq. ft.) of floor area, as
permitted in the Official Plan, on a vacant lot within the subdivision was examined.
Mr. Montemarano considered this a feasible alternative and has since filed an
application for rezoning and site plan approval (DEV 97-089) to develop 31
Freeland Drive, at the south-east corner of Freeland Drive and Swindells Street
(see Attachment No. 3).
3.7 A Public Meeting in accordance with the Planning Act is scheduled for January
5, 1998 for application DEV 97-089. The application proposes to develop the site
with 93 m2 (1000 sq.ft.) of retail floor space and a 120 m2 (1300 sq.ft.) second
floor apartment.
