1. Call to Order
Chairperson, Todd Taylor called the meeting to order at 7:OOpm

3.1 A2018-0030 Applicant/Owner: Lindvest Properties (Clarington) Limited
37 Donald Powell Crescent, Newcastle Village
Part Lot 29, Concession 2
Former Township of Clarke
The applicant, Nadia Costa, made a verbal presentation to the Committee regarding the
application. The explanation for the proposed variance was similar to what was outlined
in the report prepared for this application. During the explanation the applicant
explained that there is 6 metre privacy fence running along the rear property line.
Committee Member, James Vinson, asked the applicant to clarify whether it is a 6 metre
or 6 foot wooden fence running along the rear property line.
The applicant explained that she made an error in her explanation, and the fence is a 6
foot wooden privacy fence.
Committee Member, Andre O'Bumsawin, asked the applicant for clarification regarding
the valley lands to the rear and would they be built on.
The applicant explained that the lands are dedicated to the Municipality and a trail
system will be constructed in the future.
There were no further questions from the Committee or members of the public in
objection or support.
Moved by James Vinson, Seconded by Andre O'Bumsawin.
"Based on our review of the application, all verbal comments received and the agency
comments submitted, the application is deemed minor in nature, is considered desirable
for the appropriate development and use of the land and maintains the general intent
and purpose of the Zoning by-law and the Official Plans.
The application is approved to:
i. Reduce the minimum interior side yard setback from 4.5 metres to 3.0
metres;
ii. Reduce the minimum rear yard setback from 7.5 metres to 6.0 metres;
and
iii. Increase the maximum building height from 10.0 metres to 11.5 metres."

3.2 A2018-0031 Applicant/Owner: Cassie Connell

The applicant's agent, Mohammed Meitani, made a verbal presentation to the
Committee regarding the application. The explanation for the proposed variance was
similar to what was outlined in the report prepared for this application.
Committee Member, Andre O'Bumsawin, asked for clarification regarding whether the
deck was on the first storey or second storey of the dwelling.
Mr. Meitani explained that the rear of the dwelling has a walk out basement but the deck
is off the main floor. Ultimately, the deck is one storey above grade, however, it is off the
main floor of the dwelling to the rear.
Planner, Amanda Tapp, explained the Staff report used the wording to ensure the
committee understood the height of the proposed deck and the potential impacts on
neighbouring properties.
There were no further questions from the Committee or members of the public in
objection or support.
Moved by Andre O'Bumsawin, Seconded by John Bate.

Moved by Andre O'Bumsawin, seconded by Gord Wallace.
"That the minutes of the meeting of the Committee of Adjustment, held on May 24, 2018
be approved"
5. Other Business:
Appeal date for the foregoing applications is June 27, 2018.
Next Meeting of the Committee of Adjustment is July 5, 2018.
