Subject: pROPOBSD ZONING BY-LAW

Recommendations:
It is respectfully recommended to Council the following:
1. THAT Addendum to Report PD-4-94 be received;
2. THAT Report PD-4-94 be lifted from the table;
3. THAT the recommendations of Report PD-4-94 be approved except
for Recommendation No. 2; and
4. THAT the attached revised By-law to permit the development of
18,580 sq.m. of retail commercial floor space on the lands
subject to Rezoning Application DEV 88-099 be given first and
second reading.
1. BACRGROtTND:
1.1 At its meeting held on January 24, 1994, Council tabled Report
PD-4-94 and referred a correspondence dated January 24, 1994
from Markborough Properties to staff for comment and to report
back. Both Report PD-4-94 and the said correspondence are
attached to this Addendum Report.
2. COMLdENTS:
2.1 The suggested changes made by Markborough Properties Inc. have
been reviewed within the context of the intent of Official
Plan Amendment No. 56 and the Urban Design Plan for the West
Main Central Area. In this regard, staff agree to certain

changes but-would not recommend changes to other provisions of the
by-law.
2.2 The agreed-to changes include:
a) financial office will be comprised of one chartered bank
and one trust company or one credit union;
b) take-out eating establishment is permitted;
c) eating establishment with drive-through service is
removed as a prohibited use but limited to Area A as
identified in the By-law;
d) the floor area for supermarket is reduced from 3,500 sq.
metres to 3,000 sq. metres;
e) 5 metre setback on Street "A" as it applies to Zellers be
removed and replaced with embellished facade treatment to
be included in a site plan approval.
2.3 Other changes which staff would not recommend include:
a) increase floor area of Area "A" from 17,187 sq.m.
(185,000 sq.ft.) to 17,614 sq.m. (189,600 sq.ft.) and a
reduction of the floor area of Area "B" from 1,393 sq.m.
(15,000 sq.ft.) to 966 sq.m. (10,400 sq.ft.);
b) allowing medical and dental clinic. on the ground floor;
c) remove the requirement for street-related entrances to
business establishments within Area "B".
Staff is of the opinion that concession to these three (3)
changes is contrary to the intent of the Secondary Plan and
the Urban Design Plan as approved by Council.
2.4 Staff have advised Markborough Properties Inc. as to the
content of this Report.
