BY-LAW NO. 2010-146
being a By-law to authorize the execution of Minutes of Settlement between the
Municipality of Clarington and 902714 Ontario Inc. of claims arising out of the
expropriation of 1780 Rudell Road, Newcastle
WHEREAS Council has received and approved the Report PSD-120-10 recommending
the Settlement of Claims made by 902714 Ontario Inc. arising out of the expropriation of
1780 Rudell Road, Newcastle;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. THAT the Mayor and Municipal Clerk, on behalf of the Corporation of the
Municipality of Clarington, are hereby authorized to execute Minutes of
Settlement with 902714 Ontario Inc. for the satisfaction and release of all claims
that have been or may be made by the Owners of 902714 Ontario Inc. arising out
of the expropriation of 1780 Rudell Road, Newcastle, in order to give effect to the
settlement approved by Council.
2. THAT Council authorizes the payment by the Municipality to the Owners of
902714 Ontario Inc. or to his direction of the sum of $765,700.00 plus applicable
interest and reasonable legal and consulting fees.
