It is respectfully recommended;
1. That this report be received;
2. And that the attached by-laws re-establishing the
position of By-law Enforcement Officer and appointing
Mr. John. R. Kirkland as By-law Enforcement Officer
for the Town of Newcastle be adopted.

BACKGROUND:
In accordance with Town policy relating to the advertising of
openings, the position of By-law Enforcement Officer was posted
internally on October 22nd 1981. There was one internal
application for the position.
The position was advertised throughout the area and in response
to our advertisements, twenty-six external applications were
received. Interviews were carried out on November 17th 1981,
and eight applicants including the internal applicant were
interviewed by the Administrator, the Chief Building Official,
and the writer.

At the conclusion of the interviews, all of the qualifications of the
various candidates were re-examined. It was the unanimous opinion,
that Mr. John R. Kirkland had the background and experience we were
looking for, and would be fully capable of meeting the requirements of
the position.
I •
Mr. Kirkland was formerly employed by the Ontario Humane Society and
during his seven years with the Society, received regular promotions.
The last position held with the Society by Mr. Kirkland, was that of
Regional Superintendent for Eastern Ontario. During his employment
with the Society, he was involved in the investigation and prosecution
of a significant number of cases. Accordingly, he has become proficient
in the handling of court actions.
The interview team is satisfied, that Mr. Kirkland brings significant
skills. to the position of By-law Enforcement Officer.
In accordance with. the job rating associated with the position,
Mr. Kirkland's recommended salary will be Group 9 - $17,200 to
$19,800 (1981).

BY-LAW 81-190
being a by-law of the Corporation of the Town of
Newcastle to re-establish the position of By-law
Enforcement Officer.

WHEREAS the Council of the Corporation of the Town of Newcastle wishes
to re-establish the position of By-law Enforcement Officer;
NOW THEREFORE THE CORPORATION OF THE TOWN OF NEWCASTLE BY ITS COUNCIL,
ENACTS AS: FOLLOWS:
1. That the position of By-law Enforcement Officer is hereby
re-established;
2. That the position shall have the duties and responsibilities
as set out in Schedule "A" to this by-law;
3. That the position shall be compensated according to the
Town's policy in respect of non-union salaries.

SUMMARY OF DUTIES:
By-law Enforcement Officer
Clerk's Department
1. Responsible for the enforcement of all municipal by-laws, including
the investigation of all complaints and where appropriate the
prosecution of persons contravening the Town's zoning, licensing
and property related by-laws.
2. Responsible for the day-to-day supervision and management of the
Animal Control Section, Parking, School Crossing Guards, Taxi-Cab
and Taxi Driver licensing programs, fence viewers.
3. Act as the Town prosecutor in all by-law related cases as required.
DUTIES .AND RESPONSIBILITIES:
(a) By-law and Agreement Enforcement
1. Provision of general information and interpretation of the Town's
by-laws and agreements to the public, municipal officials, and
outside agencies, or groups.
2. Receive, catalogue and determine the nature of all complaints as
they relate to the enforcement of the Town's By-laws.
3. Ensure that the correct administrative action is taken and that
complaints are satisfactorily resolved, either through the By-law
Enforcement section of the Clerk's Department, or by referral to
the appropriate department, or agency.
4. Undertake the investigation and documentation of all alleged
infractions for court action. where necessary.
5. Provision of proper follow-up procedures of cases after
prosecution to ensure compliance with the Court's Order.
6. Preparation of the annual operational budget for the activities
managed by the By-law Enforcement Section:
7. Review and where appropriate, recommend revisions to existing
by-laws in consultation with the responsible department.
8. Develop and maintain accurate records of all activities relating
to the By-law Enforcement Section.

9. Maintain a positive corporate image.
(b) Licensing
1. Provide information and interpretation of licensing by-law
requirements and .procedures, to the public, staff and outside
agencies.
2. Receive and process applications required by the by-laws of the
Town of Newcastle. and, inform applicants of the requirements of the
Corporation relating to the issuing 'of Ticences.
3. Certify and approve .licences and renewals for issue when all
conditions have been met.
4. Administer the program associated with the issuing of licences .
and renewals of licences.
5. Undertake the processing and follow-up on complaints related to
alleged violations of the licensing by-laws, including investigation
and prosecution wherenecessary.
6. Provide investigative services to the Town's Solicitor relating to
Municipal offences when necessary.
7: Review and recommend changes to procedures. as they relate to the
general licensing process.
8. Maintain an awareness of legislative changes as they relate to
the general licensing activity..
1D. .Develop and maintain accurate records of all activities associated
with the licensing function.
11. Undertake other related duties as may be assigned by the Clerk
from time to time.
QUALIFICATIONS:
1." Minimum of Grade 12 education.
2. Knowledge of court procedures and the statutes as they relate to
Qy-law Enforcement.
3. Proven, enforcement, management and. supervisory skills.
4: Proven written and verbal communication skills including the ability
to communicate effectively with members of the public.
5. Valid motor vehicle operator's licence.

being a by-law of the Corporation of the Town
of Newcastle to appoint a By-law Enforcement
Officer
The Municipal Council of the Corporation of the Town of Newcastle
hereby ENACTS AS FOLLOWS:
1. THAT Mr. John R. Kirkland is hereby appointed By-law Enforcement
.Officer to the Town of Newcastle during the pleasure of Council;
2. THAT Mr. John R. Kirkland shall be paid for his services in
accordance with the terms and conditions as set out in Schedule "A"
attached hereto.
3. THAT John R. Kirkland shall commence his duties as By-law Enforcement
Officer on Tuesday, November 24th 1981.
4. THAT By-law No. 78-11 is hereby repealed.

TO DY-law 81-191
Terms and Conditions of Appointment of Mr. John R. Kirkland
The following shall be the terms and conditions of the employment of
Mr. John R. Kirkland as By-law Enforcement Officer for the Town of
Newcastle, namely;
1. Mr. John R. Kirkland shall be employed as By-law Enforcement Officer;
2. The duties and responsibilities of the By-law Enforcement Officer are
those established by By-law No. as may be amended from time:
to time;
3. Mr. John R. Kirkland shall be remunerated in accordance with the
• Town's policy in respect to the compensation for non-affiliated
staff and more specifically, shall be paid at salary grade established
in Grade 9.
4. Mr. John R. Kirkland shall be entitled to all other employee
benefits enjoyed by all other non-affiliated staff as may be
determined .from time to time.
