Stapleton led the meeting in Prayer. Roll Call Present Were: Mayor J. Winters Councillor A. Cowman Councillor D. Hamre Councillor M. Hubbard Councillor H. McKnight Councillor F. Rutledge Resolution #C-1018-87 Minutes Moved by Councillor Hubbard, seconded by Councillor Stapleton THAT the Minutes of a regular meeting of Council heldon Monday, December 14, 1987, be approved as corrected. "CARRIED" Delegations Mr. F. Hayward, R. R. 6, Bowmanville, informed Council that because his home is on Highway #2 and is zoned commercial, he must pay $1,350.00 for water connection. Mr. Hayward is on a pension and has a wife confined to bed. The residents in the affected Courtice Area in the residential zone are obtaining their hookups for $300.00, because of the grant the Region secured from the Province and Developer contributions. Mr. Hayward's well went dry when construction began on Varcoe Road. The commercial areas are excluded from the grant. Mr. Hayward would like to have his water for $300.00. The Region is removing the hose pipe which is connected to his well. When this is done, Mr. Hayward is concerned that he won't have any water. Rev. N. E. Schamerhorn, St. Paul's United Church, 190 Church Street, Bowmanville, Ontario, L1C 1T9, announcing the presentation of their annual "Living Nativity" so that the Town may take any action they deem necessary for safe traffic management be received for information. "CARRIED AS AMENDED" Resolution #C-1020-87 Moved by Councillor Hamre, seconded by Councillor Hubbard THAT Resolution #C-1019 be amended and the following added: THAT the Chief Administrative Officer bring this item to the attention of the Durham Regional Police. "CARRIED" I - 2 Resolution #C-1021-87 Growth of Ragweed Moved by Councillor Hubbard, seconded by Councillor Cowman on Road Allowances MHAT the communication dated December 3, 1987, from James 77.2.102. Slyfield, R. R. 1, Bowmanville, regarding the control of weeds be received. "CARRIED AS AMENDED" Resolution #C-1022-87 Moved by Councillor Hamre, seconded by Councillor Wotten THAT Resolution #C-1021 be amended and the following added: THAT Mr. Slyfield's letter be referred to Public Works for their information. "CARRIED" D - 1 Resolution #C-1023-87 Kidney Month Moved by Councillor Hubbard, seconded by Councillor Hamre 10.2.11. THAT the communication dated December 1, 1987, from Harold Cobb, Executive Director, The Kidney Foundation of Canada, Toronto & District Chapter, 1200 Eglinton Ave. E., Suite 401, Don Mills, M3C 1H9, requesting assistance in proclaiming March as Kidney Month be received; Council Minutes - 3 - December 21, 1987 Communications Resolution #C-1023-87 Cont!d AND THAT March be declared as "Kidney Month" in the Town of Newcastleand advertised in accordance With. -Town Policy and further that upon receipt of the Kidney Foundation's Flag, it be flown during the same month; AND FURTHER THAT Harold Cobb be advised of Council's decision. "CARRIED" D - 2 Resolution #C-1024-87 Public Address Moved by Councillor Hubbard, seconded by Councillor Hamre System, New Administrative THAT the communication dated December 8, 1987, from Facility Rev. N. E. Schamerhorn, 190 Church Street, Bowmanville, 10.2.11. requesting the installation of a proper public address system in the new Town Hall, be received and referred to 1988 Budget discussions. "CARRIED" D - 3 Resolution #C-1025-87 Dangerous Area Moved by Councillor Hamre, seconded by Councillor Hubbard Newtonville Road 77.2.102. THAT the communication dated December 7,1987, from I. L. Veldhuis, Newtonville, bringing to Council's attention two very dangerous areas along Newtonville Road South, be received and referred to Public Works for a report to the General Purpose and Administration Committee. "CARRIED" Reports Resolution #C-1026-87 Moved by Councillor Hubbard, seconded by Councillor Hamre THAT the General Purpose and Administration Committee Report for December 21, 1987, be approved. "CARRIED" Mayor Winters made_,.a�declaration of interest relative to Report PD-308-87; vacated his chair and refrained from discussion and voting on the subject matter. Mayor Winters has an interest in the subject lands. Councillor Cowman chaired this portion of the meeting. Council Minutes - 4 - December 21, 1987 Unfinished Business Resolution #C-1027-87 Application to Close Moved by Councillor Hubbard, seconded by Councillor Hamre Portions of Edsall Ave. & Rehder Ave. THAT Resolution #C-976-87 respecting the tabling of an 77.44.137. application to close portions of Edsall Avenue and Rehder Avenue, until the issue outlined in Resolution #C-962-87 was clarified, be lifted from the table and dealt with at this time. "CARRIED" Delegation Resolution #C-1028-87 Moved by Councillor Hubbard, seconded by Councillor Hamre THAT in accordance with current Town Policy, the Road Allowances, the subject of Report PD-308-87, be closed and conveyed subject to any necessary easements and all legal and survey fees to be paid by the applicant. Resolution #C-1029-87 "CARRIED" Nay Councillor Stapleton Councillor Wotten Mr. Hayward Moved by Councillor Cowman, seconded by Councillor Wotten THAT the presentation of Mr. Frank Hayward be acknowledged; ANDLTHAT the Town of Newcastle advise the Region of Durham that the Town will reimburse the Region of Durham $1,050.00 for the municipal water hookup to the home of Mr. Frank Hayward, out of the O.H.A.P. Impact Account. Funds can be legally used for the purpose proposed; AND THAT if the advice is that O.H.A.P. Funds cannot be used that the matter be referred to the Ministry of Environment for a hearing to determine whopis legally responsible for the dewatering of Mr. Hayward's well and subsequent appropriate action to be taken to recover the cost; AND FURTHER THAT Mr. Hayward be advised of Council's actions. "CARRIED" Resolution #C-1033-87 Moved by Councillor Hubbard, seconded by Councillor Wotten THAT the second reading of By-law 87-207 be approved. "CARRIED" Resolution #C-1034-87 Moved by Councillor Hubbard, seconded by Councillor Wotten THAT the third and final reading of By-law 87-207 be approved. "CARRIED" Resolution #C-1035-87 Moved by Councillor Stapleton, seconded by Councillor McKnight THAT leave be granted to introduce By-law 87-208, being a by-law to confirm the proceedings of the Council of the Town of Newcastle at this meeting held on the 23rd day of November 1987, and that the said by-law be now read a first time._ "CARRIED" Resolution #C-1036-87 Moved by Councillor Stapleton, seconded by Councillor McKnight THAT the second reading of By-law 87-208 be approved.
