HomeMy WebLinkAbout2010-075CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NO. 2010-075 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the former Town of Newcastle WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Municipality of Clarington for ZBA 2010-0010; NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Section 18.4 "Special Exceptions -Hamlet Commercial (C3) ZONE" is hereby amended by adding thereto, the following new Special Exception zone 18.4.9 as follows: "18.4.9 Hamlet Commercial Exception (C3-9) Zone Notwithstanding the provisions of 18.1 and 18.3 c. iii), those lands zoned "C3-9" on the Schedules to this By-law may be only used in accordance with the following: a. Definitions i) Farm-related commercial establishment: Shall mean afarm-related commercial use that is small in scale, required in close proximity to a farm and directly related the business of farming and shall include a feed store. b. Permitted Uses i) Afarm-related commercial establishment; ii) A single detached dwelling; 2. 3. 4. c. Regulations for non-residential uses i) Interior Side Yard (minimum) ii) Total Floor Area (maximum) 3 metres 500 square metres Schedule "18" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from: "Residential Hamlet (RH) Zone" to "Hamlet Commercial (C3-9) Zone" Schedule "A" attached hereto shall form part of this By-law. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
